RE:

Establishment of an organized collection service for residential recycling within the City limits of Lawrence, Kansas

 

On February 12, 2013, the City Commission directed staff to prepare an ordinance implementing residential recycling collection services and negotiate a contract with N.R. Hamm Quarry LLC for recyclable materials processing and marketing services.

 

Please place the following items on the City Commission Agenda for consideration at the March 26, 2013 meeting:

 

(1)  Close public hearing for the proposed plan for the establishment of an organized collection service for residential recycling and approve the plan.

(2)  Adopt on first reading Ordinance No. 8851 establishing an organized collection service for residential recycling within the City limits of Lawrence, if appropriate.

(3)  Authorize the Mayor to enter into an agreement with N.R. Hamm Quarry LLC for recyclables processing and marketing services.

 

As required by the Organized Collection Service Act, K.S.A. (2011 Supp.) 12-2034, et seq., the City of Lawrence may not commence the organized recycling collection service for a period of at least 18 months from the adoption of the ordinance (timeline of action steps).

 

For your reference, attached is supplemental information for the plan for the establishment of an organized collection service for residential recycling.

 

Descriptions (key points)

 

Plan:  The plan addresses items listed in K.S.A. (2011 Supp.) 12-2034, et seq.  All interested persons, including licensees and other persons operating recycling collection services in Lawrence at the time the City passed the resolution of intent, were invited to participate in the planning meetings during the 90-day period following the adoption of Resolution No. 6976.  The proposed plan, reviewed by the City Commission on December 11, 2012, was amended to include a supplemental information section per direction from the City Commission.

 

Ordinance:  The ordinance establishes an organized collection service for residential recycling in Lawrence.  The City will offer a collection service of recyclable materials for single-family and multi-family dwellings.  The ordinance establishes residential recycling service charges and service details.  This service will be mandatory pay, voluntary participation. 

 

The single-family customers’ recycling collection service will be matched to the type of trash service each customer currently has (curbside or alley collection).  If a customer lives in a neighborhood serviced by trash dumpsters then the City will co-locate a recycling dumpster in the same area.  For single-family customers who do not receive dumpster trash service, the standard recycling cart size will be 95 gallons.  Customers will have the option of requesting an alternative size cart, additional carts, or declining to participate.  Collection will be every-other-week using City crews and City equipment.  Multi-family customers will be served by containers of a type and location similar to their trash service.  If services are paid on a commercial trash basis, property owners will be responsible for the recycling charges for the number of units in each dwelling. 

 

Contract:  Per City Commission direction from the February 12, 2013 Commission meeting, staff negotiated a contract between the City of Lawrence, the collector of residential recyclable materials, and N. R. Hamm Quarry LLC, the contractor/operator of the Material Recovery Facility that will process and market the recyclable materials collected by the City.  The contract outlines relevant details to ensure a productive partnership in diverting waste from the landfill and establishes the term of agreement (7-year initial term with an option for two 3-year renewals).  The City of Lawrence and N. R. Hamm Quarry LLC proposals were selected from an RFP process.  The RFP Review Committee’s pricing analysis, decision options and action requested for the City Commission is documented in the February 6, 2013 memo.

 

Recommended actions

 

(1)  Close public hearing for the proposed plan for the establishment of an organized collection service for residential recycling and approve the plan.

(2)  Adopt on first reading Ordinance No. 8851 establishing an organized collection service for residential recycling within the City limits of Lawrence, if appropriate.

(3)  Authorize the Mayor to enter into an agreement with N.R. Hamm Quarry LLC for recyclables processing and marketing services.
