RE:	Initiate Rezoning for 306 Elm Street from CS to RS5

Initiate rezoning of 306 Elm Street from CS (Commercial Strip) District to RS5 (Single-Dwelling Residential) District.

Rezoning will require a public hearing before the Lawrence-Douglas County Planning Commission before a recommendation is submitted to the Lawrence City Commission for a final decision.

Background

The use of 306 Elm Street – detached dwelling – does not match the current zoning of the property, which is CS (Commercial Strip) District.  The CS District does not permit detached dwellings. 

The properties to the east of 306 Elm Street are zoned RS5 (Single-Dwelling Residential) District.  The majority of the 300 block of Elm Street is zoned RS5.  The RS5 District is appropriate for the subject property going forward.  The property owner has been contacted and has agreed to this rezoning initiation.

Recommendation: Initiate the rezoning of 306 Elm Street from CS (Commercial Strip) District to RS5 (Single-Dwelling Residential) District.
