RE:	First Amendment to Development Agreement – Poehler Building Project

Background

Earlier this fall, the City Commission authorized the City to enter into a Development Agreement for the redevelopment of the Poehler Building located near 8^th and Pennsylvania Streets.  With the replatting for the Poehler Building project, the legal descriptions for the project parcel and the parking lot have changed.  The Development Agreement must be amended to include the revised legal descriptions.  Section 6.02 of the Development Agreement provides that any amendments to the agreement or its attached exhibits may only be amended in writing, and upon the official action of the governing body. The attached First Amendment to Development Agreement is attached for approval.  There are no other changes to the Development Agreement. 

Action Requested: Authorize the Vice-Mayor to execute the First Amendment to the Development Agreement.
