A protest petition was filed in the City Clerk’s Office on November 8, 2011 pertaining to the referenced request for rezoning. The petition bears the signature of one record owner of property in the required notification area. They own approximately 44% of the real property in the notice boundary area which is enough to constitute a valid protest petition objecting the rezoning of the reference property. The property owner notification list prepared by the Douglas County Clerk’s Office included parcels lying within 200’ of the property in the rezoning request.
Six (6) parcels are partially contained within the 200 feet notification distance of the property in the rezoning request. The total area of the property represented by these 6 parcels is 424,995.7 square feet (9.76 acres). The protest petition was signed by one property owner who has 188,436.4 square feet (4.32 acres) or approximately 44.26% of the total property within the notification area. The protest petition is therefore valid because it bears the signature of a property owner who owns enough land in the notification area to meet or exceed the minimum 20% required by Code to constitute a valid protest petition.
The attached map illustrates the properties within the protest area whose owners are protesting this rezoning request.
