Arts Center Final Friday Street Party Event Alcohol Hearing |
The City Commission approved a Temporary Use of Public Right-of-Way Permit for the closure of a portion of the 900 block of New Hampshire from noon to midnight on Friday, September 30, 2011, for a Lawrence Arts Center street party. The event would include live music, games, and vendors, and would close the 900 block of New Hampshire from approximately the northern edge of the parking garage to just north of the southernmost entrance to the parking garage.
Organizers of the event have also requested permission to sell alcohol which would be possessed and consumed on the right-of-way outside of the Arts Center. To accommodate this request, a public hearing for a distance limitation waiver (because the event would be within 400’ of a church) and adoption of an ordinance to allow possession and consumption on the right-of-way are necessary. A public hearing for this event was scheduled for September 6 and the Salvation Army was notified by telephone and in writing. Captain Wesley Dalberg of the Salvation Army indicated to me that the Salvation Army does not oppose this request.
If the City Commission wishes to allow the possession and consumption of alcohol on the right-of-way for this event, the City Commission most hold a public hearing, find that the proximity of the even to the church is not adverse to the public welfare or safety, grant a distance limitation waiver, and adopt on first reading Ordinance No. 8666, allowing the possession and consumption of alcohol on the public-right-of-way during the event.
ACTION: Hold a public hearing; find that the proximity of the Arts Center street party is not adverse to the public welfare or safety; grant a distance limitation waiver; and adopt on first reading Ordinance No. 8666, if appropriate.
