RE:              1040 Vermont Right of Way Agreements

At its April 5, 2011, regular meeting, the City Commission approved the 1040 Vermont Street Neighborhood Revitalization Area Plan. As part of that plan, 1040 Vermont, LLC, will be redeveloping the property at 1040 Vermont Street. That redevelopment, as planned and approved, will involve construction of a building that will overhang onto a portion of the Vermont Street Right of Way and use a portion of the Alley Right of Way between Massachusetts Street and Vermont Street for a fire escape. The City has required 1040 Vermont Street to obtain License Agreements for the proposed uses of those rights of way. City Staff and 1040 Vermont, LLC, have reached an agreement on the language to be used in the License Agreements. 1040 Vermont, LLC, has executed those License Agreements and they await the signature of the City Manager to become final.

 

Action Requested: Staff requests the City Commission to authorize the City Manager to execute License Agreements permitting 1040 Vermont Street to use certain portions of the Vermont Street Right of Way and the Alley Right of Way between Massachusetts Street and Vermont Street in accordance with the terms of those agreements.
