Lot 1 Pinnacle West Subdivision No. 10 (MS-5-2-11) Variance request from City Code 19-214(B)

 

Please include the following item on the City Commission agenda for consideration at the July 19, 2011 meeting:

Approval of the request by Grob Engineering on behalf of Bechtel Holdings LLC for a variance from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a public utility easement for greater than 15 feet for Lot 1 of Pinnacle West Subdivision No. 10.

Grob Engineering recently submitted a minor subdivision request, MS-5-2-11, for the property located at 4311 West 6th Street. The minor subdivision of this property is a split of the existing lot 11A of Pinnacle West No. 9 into Lot 1 and Lot 2 as shown on the minor subdivision.

4311 West 6th Street is currently occupied by two buildings that are independently served by the public sanitary sewer system. The subdivision of Lot 11A effectively isolates Lot 1 from the public sanitary sewer system. This has been addressed by dedicating a utility easement across Lot 2 to ensure that Lot 1 has continued access to the public sanitary sewer system. With the dedication of the public utility easement across Lot 2, the existing sanitary sewer service line for Lot 1 will extend more than 15 feet within public utility easement and this variance request will bring Lot 1 into compliance with current City Code.

Action Request:

Approval of the requested variance from 19-214B of the City Code for Lot 1 of Pinnacle West No. 10, a minor subdivision of Lot 11A, Block 1, Pinnacle West No. 9
