Dillon’s Sidewalk Dining and Hospitality License
|
Dillon’s, 1740 Massachusetts Street, has applied for a Sidewalk Dining and Hospitality License. Although such licenses in the past have only been issued in the downtown area, Dillon’s proposed use of the right-of-way fits the definition of a sidewalk dining and hospitality use and therefore requires the same license as the downtown establishments.
The applicant has submitted all required application materials with the exception of “a written statement from each adjoining property owner, and any tenant of each adjoining property expressing a lack of objection to the proposed sidewalk hospitality use” (City Code 6-1202.1). Because those statements have not been provided by the applicant, a public hearing to determine whether to grant the license must be held. Per the City Code, notice of this hearing was sent to adjacent property owners. Following the public hearing, if the City Commission wishes to grant the license, the Commission must find that the proposed sidewalk dining and hospitality use is within the public’s interest.
ACTION: Hold a public hearing; find that the use of the public right-of-way for a sidewalk dining and hospitality area for Dillon’s, 1740 Massachusetts Street, is within the public’s interest; and approve issuance of a Sidewalk Dining and Hospitality License, if appropriate.
