Please include the following item on the City Commission consent agenda for consideration at the April 12, 2011 meeting:
Project Description. KU is making improvements to the entrances/exits of the Mississippi Street parking facility. The improvements include installation of parking control equipment (automatic gates/arms) to allow ingress/egress. At the Oread Avenue entrance/exit the parking control equipment needs to be placed within City right-of way to allow for adequate turning movements and minimum stacking of vehicles.
Project Status. KU is requesting a License Agreement for the use of City right-of-way for the installation of the parking control equipment. The License permits the “Owner” (KU) of the improvements to use the right-of-way for the stated purposes. The University of Kansas is responsible for installation and maintenance. The agreement indemnifies the City against claims and liabilities which arise from KU’s use of the right-of-way. They are to provide insurance, and should the City need the right-of-way for any reason KU would need to remove the improvements at their cost within thirty (30) days.
Staff has reviewed the project and determined that the improvements will not have an affect on any City infrastructure. The Legal Department has also approved the License Agreement.
Requested Action: Authorize Mayor to sign a License Agreement with the University of Kansas for the installation of parking control equipment in the Oread Avenue right-of-way.
