ORDINANCE NO. 8625

 

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS ADOPTING A NEIGHBORHOOD REVITILIZATION PLAN, DESIGNATING A NEIGHBORHOOD REVITILIZATION AREA AND ESTABLISHING A FUND FOR 1040 VERMONT STREET ALL IN ACCORDANCE WITH THE KANSAS NEIGHBORHOOD REVITALIZATION ACT

 

WHEREAS, pursuant to the authority provided in the Kansas Neighborhood Revitalization Act, K.S.A. 12-17,114 et seq. (“the Act”), the Governing Body of  the City of Lawrence, Kansas desires to adopt a plan for the revitalization of 1040 Vermont Street in Lawrence, Kansas, to designate 1040 Vermont Street in Lawrence, Kansas as a neighborhood revitalization area, and to create a fund to finance the redevelopment of the area and to provide rebates authorized by the Act, all in accordance with the Act;

 

WHEREAS, on March 15, 2011, the Governing Body set a public hearing for April 5, 2011, for the purpose of considering adopting a plan for the revitalization of 1040 Vermont Street, pursuant to the Act; and

 

WHEREAS, the Governing Body caused a notice of such public hearing to be published in The Lawrence Journal-World, a newspaper of general circulation within the City of Lawrence, on March 21,  2011, and March 28, 2011, in accordance with the Act; and

 

WHEREAS, the Governing Body, pursuant to said public notice held a hearing on April 5, 2011 to hear and consider public comment on the Neighborhood Revitalization Plan and Program for 1040 Vermont Street.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE KANSAS:

 

Section One:   The Governing Body hereby adopts the Neighborhood Revitalization Plan and Program for 1040 Vermont Street attached hereto as Exhibit A and incorporated by reference.

 

Section Two.  The Governing Body finds that the property legally described as Lots 108, 110, 112 Vermont Street, Lawrence, Douglas County, Kansas  and commonly known as 1040 Vermont Street in Lawrence, Douglas County, Kansas  is an area in which there is a predominance of buildings or improvements which by reason of age, history, architecture or significance should be preserved or restored to productive use and such condition is one of the conditions described in subsection (c) of K.S.A. 12-17,115 and amendments thereto.  The Governing Body further finds that the rehabilitation, conservation or redevelopment of the area is necessary to protect the public health, safety or welfare of the residents of the City of Lawrence, Kansas.  Accordingly, the Governing Body hereby designates the property legally described above as the 1040 Vermont Street Neighborhood Revitalization Area (the Revitalization Area).

 

Section Three. The Governing Body does hereby create a Neighborhood Revitalization Fund pursuant to K.S.A. 12-17,118 to finance the redevelopment of the Revitalization Area and to provide a rebate of property tax increments as set forth in the Revitalization Plan.

 

Section Four: This ordinance shall take effect and be in force from and after its passage and publication as provided by law.
