License Agreement

333 Johnson Avenue

 

Mrs. Diane Trybom, owner of the property located at 333 Johnson Avenue, has submitted a request to place a small landscape/retaining wall within the right-of-way behind the curb.  The right-of-way between the sidewalk and the curb is very steep and difficult to maintain/mow.  The landscaping/retaining wall would create a level area and prevent slipping.  Similar small landscaping walls exist in the neighborhood.

 

The license agreement indemnifies the City against any claims and only grants the owner (licensee) permission to use the right-of-way.  The owner is responsible for installation and maintenance costs.   If the right-of-way is needed for any reason by the City or franchise users, the cost to remove, relocate, or repair the improvement is at the owner (licensee) expense.

 

All utility companies were notified and have no objections/concerns.  Planning, HRC and Development Services also reviewed and have no objections.  Legal staff has reviewed the standard agreement.

 

Action requested:  Pending City Commission review, city staff would recommend approval of the License Agreement.
