THIRD ADDENDUM TO CONTRACT

 

            Whereas, on October 10, 2006, the City of Lawrence, Kansas (“City”) and David L. Corliss (“Employee”) entered into an Employment Agreement (“the Contract); and

 

 

            Whereas, on March 6, 2007, the City and Employee caused an Addendum to the Contract to be approved; and

 

 

            Whereas, on April 14, 2009, the City and Employee caused a Second Addendum to the Contract to be approved; and

 

 

            Whereas, the City and Employee desire a third Addendum to the Contract;

 

 

            NOW THEREFORE, the City and the Employee agree as follows:

 

1.         The recitals set forth above are incorporated herein by reference as if fully set forth.

 

2.         Section 5.b. of the Contract is amended to read as follows: 

 

Deferred Compensation.  The City shall, in addition to other compensation provided for in this Agreement, as amended by the Addendum to Contract and Second Addendum to Contract, contribute $16,500.00 per year payable in installments on a pro-rata basis on behalf of the employee to a deferred compensation program of the Employee’s choice.  Any amount over the $16,500.00 that can be legally deferred that the Employee chooses will be deducted from the base salary of the Employee. 

 

3.         Paragraph 2 of the Second Addendum to Contract amending Section 6.a. of the Contract is amended to provide that the Employee may accrue up to 900 hours of vacation leave. 

 

4.         Section 5 of the Agreement is further amended to include the following provision:

 

            The Employee may elect, subject to the Mayor’s approval that the City’s payment procedures have been followed, to exchange any or all of Employee’s accrued vacation leave in excess of 600 hours for compensation on a pro rata basis at the Employee’s hourly rate of pay.  The Employee may make such request to exchange Employee’s accrued vacation leave over and above 600 hours for compensation no more frequently than once per calendar quarter.  Said compensation shall be subject to all applicable taxes and withholdings. 

 

5.         The amendments set forth in this Third Addendum to Contract shall be effective as of the first regular pay period of 2011. 

 

6.         All other provisions of the Contract, the March 6, 2007 Addendum to Contract and the April14, 2009 Second Addendum to Contract are reaffirmed.

 

IN WITNESS WHEREOF, the parties have caused this Third Addendum to Contract to be approved.
