Steps for Establishing a Neighborhood Revitalization Area (NRA):

 

Step 1: The municipality must make a finding of fact that the property/ies in the area are eligible for tax rebates as defined by the Neighborhood Revitalization Act

-         an individual property or properties may qualify for a NRA status if there is:

·          dilapidation or deterioration related to obsolescence or structural integrity;

·          the building or area is detrimental to health, safety, or welfare of inhabitants of the building or area; or

·          a building is historically worthy of preservation.

 

Step 2: Call and hold a public hearing for the proposed NRA and Revitalization plan (see Step 3 for contents of the revitalization plan).  The hearing time and date must be published once a week for two consecutive weeks prior to the hearing.

 

Step 3: A revitalization plan must be adopted by the governing body that includes:

-         legal description of the revitalization area

-         existing assessed valuation of the area, listing land and building values separately;

-         names and addresses of the owners of record in the proposed district;

-         existing zoning classifications and land use boundaries and proposed zoning and land use boundaries;

-         proposal for improving and expanding municipal services in the area;

-         statement specifying what property is eligible for revitalization and whether the program applies to existing buildings, new construction, or both;

-         criteria used to determine what property is eligible;

-         contents of an application for the tax rebate;

-         procedure for submitting the application;

-         criteria to be used when reviewing and approving application;

-         maximum amount and years of eligibility

-         For a proposal that is only an individual building, the following are also needed:

·          Legal description of the property

·          Assessed value of the property with separate values for land and building

·          Owner of record for the structure

 

Step 3a: An ordinance should establish the program.  It should state that a public hearing was held and specify the date; adopt the revitalization plan from Step 3; designate the NRA for participation in the program; and establish a neighborhood revitalization fund (Step 4).

 

Step 4: Establish a neighborhood revitalization fund.  Similar to establishment of a budget fund, and can be established by adding a section in the ordinance used to adopt the revitalization plan.

 

Rebates- each taxing jurisdiction must agree to the rebates.  School district tax levies are included.  State aid to school districts is not affected by their participation in an NRA.
