Clemente Addition (MS-12-09-10) Variance request from City Code 19-214(B)

 

Please include the following item on the City Commission agenda for consideration at the January 04, 2011 meeting:

Approval of the attached request by Landplan Engineering, P.A. on behalf of DC Holdings, LC, the property owner of record of 3801 West 6th Street, for a variance from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet.

Landplan Engineering, P.A. recently submitted a minor subdivision request, MS-12-09-10, for the property located at 3801 West 6th Street. The minor subdivision proposes splitting the existing single lot into three lots and a single tract dedicated for stormwater detention purposes.

The property is currently occupied by a single building which is legally served by sanitary sewer. While the existing sanitary sewer line will not be modified as part of the minor subdivision request; the existing sanitary sewer service line will extend more than 15 feet within a dedicated utility easement and this variance request will bring the property into compliance with current City Code.

Action Request:

Approval of the requested variance from 19-214B of the City Code for 3801 West 6th Street.
