Please include the following item on the City Commission consent agenda for consideration at the November 23, 2010 meeting:

Project Description/History: The 2010 Overlay Program Phase 2 was awarded to Kansas Heavy Construction, LLC on June 22, 2010.  This curb and gutter and milling and overlay project included a number of City residential and collector streets.  The completed street curb and gutter and mill and overlay sections were determined to be in generally fair to poor condition and deteriorated beyond the point at which cost-effective preventative maintenance techniques could be performed.

Project Funding:  The current contract amount is $1,369,099.80.  This project saw an overall increase of $109,677.06 over the awarded contract amount due to increased quantities of curb and gutter, concrete and asphalt pavement, and full depth pavement patching.

As described, the contract amount will total $1,478,776.86.  The change order amount impacts the total contract amount but does not result in exceeding previously approved budget allocations.

Action Request:  Approve Change Order No. 1 & Final to Kansas Heavy Construction, LLC in the amount of $109,677.06.
