ORDINANCE NO.  8593

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS ADOPTING AND INCORPORATING BY REFERENCE THE COMMUNITY DESIGN MANUAL NOVEMBER 2010 EDITION,  PREPARED BY THE LAWRENCE-DOUGLAS COUNTY METROPOLITAN PLANNING OFFICE OF THE CITY OF LAWRENCE, KANSAS.

WHEREAS, on July 25, 2006, the City Commission adopted by Resolution No. 6669 the Community Design Manual-Commercial Development, July 2006 Edition; and

WHEREAS, on October 27, 2010, the Lawrence-Douglas County Metropolitan Planning Commission recommended approval of the Commercial Design Manual-Industrial Development Section; and

WHEREAS, on October 27, 2010, the Lawrence-Douglas County Metropolitan Planning Commission recommended approval of text amendments to Chapter 20, the Development Code of the City of Lawrence, Kansas pertaining to a Commercial Design Manual that includes both the Commercial and Industrial Development standards; and

WHEREAS, the Community Design Manual November 2010 Edition shall include the Community Design Manual-Commercial Development, adopted by the City Commission on July 25, 2006 and the Commercial Design Manual-Industrial Development Section approved by the Lawrence-Douglas County Metropolitan Planning Commission; and

WHEREAS, pursuant to the provisions of K.S.A. 12-3009 et seq. and the Home Rule Authority of the City as granted by Article 12, § 5 of the Constitution of Kansas, the City is authorized to adopt by ordinance and by incorporation by reference, planning and zoning laws and regulations.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

SECTION ONE:  The above stated recitals are by reference incorporated herein and shall be effective as if repeated verbatim.

SECTION TWO: Adoption by reference of the Community Design Manual; Relationship to other provisions of the City Code.

The “Community Design Manual November 2010 Edition” prepared, compiled, published and promulgated by the City of Lawrence, Kansas is hereby adopted and incorporated by reference as if fully set forth herein, and shall be known as the “Community Design Manual November 2010 Edition.”  At least one copy of the “Community Design Manual November 2010 Edition” shall be marked or stamped as “Official Copy as Adopted by Ordinance No.  8593 and to which shall be attached a copy of this ordinance, and filed with the City Clerk, to be open to inspection and available to the public at all reasonable business hours.  The police department, municipal judge, and all administrative departments of the City charged with the enforcement of the ordinance shall be supplied, at the cost of the city, such number of official copies of such “Community Design Manual November 2010 Edition” marked as may be deemed expedient.  Subsequent City Code references to the "Community Design Manual" shall mean the "Community Design Manual November 2010 Edition,” as adopted herein.

SECTION THREE: Resolution No. 6669 adopting the Community Design Manual-Commercial Development, July 2006 Edition, is hereby repealed it being the intent of this ordinance to supersede the repealed provisions.

SECTION FOUR:  This ordinance shall take effect and be in force from and after its passage and publication as provided by law.
