RE:

Extension requests for the following items:

FDP-08-05-06: Prairie Wind Final Development Plan for 17 dwelling units on 2.59 acres for a density of 6.56 units/acre. Approved by Planning Commission on September 25, 2006. 

 

PF-08-22-06: Prairie Wind Final Plat. A one-lot subdivision approved by the Planning Commission on September 25, 2006. Dedications were accepted by City Commission on October 10, 2006 and a 6 month extension request was approved by Planning Commission on September 24, 2007.

 

The Final Development Plan and Final Plat referenced above for the Prairie Wind Development at 2620 Haskell Avenue were approved and have been recorded.  However, development did not commence within the time frame required by Code and the approval of these items expired. The applicant continued to move forward with the project, unaware that these items had expired, and completed the Public Improvement Plans which were approved by the City Engineer on June 4, 2009.

 

The applicant worked through the development process until the associated rezoning was published and the plans were recorded, but further progress was delayed due to the economic situation. The continuing work on the public improvement plans indicates that it was the applicant’s intent to continue with the project.

 

The applicant has requested the maximum extension permitted by Code. Per Section 20-1304(e)(2)(vii) of the Development Code an extension of up to 24 months is permitted  for final development plans. As the Subdivision Regulations do not contain an extension provision, the same extension time frame would be applicable to the plat. The extension would apply retroactively to the expiration dates (see attached timeline); therefore a 24 month extension has been requested.

 

Written notice of this extension request was provided to property owners within 200 ft of the subject property 20 days prior to the City Commission meeting. One call was received from a property owner prior to the drafting of this memo. The property owner wanted to confirm that there were no changes being proposed to the plan. No changes are being proposed; the extension request is for the final development plan and plat as approved by the Planning Commission.
