ORDINANCE NO. 8583

 

AN ORDINANCE OF THE CITY OF LAWRENCE, KANSAS REGULATING CHAPTER V, BUILDING AND CONSTRUCTION AND RELATED ACTIVITIES WITHIN THE CORPORATE LIMITS OF THE CITY OF LAWRENCE, KANSAS; AND AMENDING, ENACTING AND REPEALING EXISTING SECTIONS IN ARTICLES 1, 2, 7, 8 AND 9 OF CHAPTER V OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2009 EDITION, AND AMENDMENTS THERETO.  

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

 

Section 1.  Chapter V, Article 1, Section 5-101 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-101  SEVERABILITY.

If any section, clause, sentence, or phrase of this Article ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this Article ordinance.

 

Section 2.  Chapter V, Article 1, Section 5-109 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-109 ELECTRICAL.

The provisions of the National Electrical Code shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures, fittings and appurtenances thereto.

 

Exception:  Buildings or structures regulated by the International Residential Code.

 

Section 3.  Chapter V, Article 1, Section 5-110 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-110 GAS.

The provisions of the International Fuel Gas Code shall apply to the installation of gas piping from the point of delivery, gas appliances and related accessories as covered in this Article.  These requirements apply to gas piping systems extending from the point of delivery to the inlet connections of appliances and the installation and operation of residential and commercial gas appliances and related accessories.

 

Exception:  Buildings or structures regulated by the International Residential Code.

 

Section 4.  Chapter V, Article 1, Section 5-111 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-111 MECHANICAL.

The provisions of the International Mechanical Code shall apply to the installation, alterations, repairs and replacement of mechanical systems, including equipment, appliances, fixtures, fittings and/or appurtenances, including ventilating, heating, cooling, air-conditioning and refrigeration systems, incinerators and other energy-related systems.

 

Exception:  Buildings or structures regulated by the International Residential Code.

 

Section 5.  Chapter V, Article 1, Section 5-112 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-112 PLUMBING.

The provisions of the International Plumbing Code shall apply to the installation, alteration, repair and replacement of plumbing systems, including equipment, appliances, fixtures, fittings and appurtenances, and where connected to a water or sewage system and all aspects of a medical gas system.

 

Exception:  Buildings or structures regulated by the International Residential Code.

 

Section 6.  Chapter V, Article 1, Section 5-115 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-115 ENERGY.

The provisions of the International Energy Conservation Code shall apply to all matters governing the design and construction of buildings for energy efficiency.

 

Exception:  Buildings or structures regulated by the International Residential Code.

 

Section 7.  Chapter V, Article 1, Section 5-128 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-128  BUILDING EVALUATION.

The code official is authorized to require an existing building to be investigated and evaluated by a registered design professional based on the circumstances agreed upon at the preliminary meeting to determine the existence of any potential nonconformance with the provisions of this Article.  The design professional shall notify the code official of any potential nonconformance with Chapter V, Article 9, Existing Building Code, and amendments thereto.

 

Section 8.  Chapter V, Article 1, Section 5-144 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-144  WORK EXEMPT FROM PERMIT.

Exemptions from permit requirements of this Article shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this Article or any other laws or ordinances of this jurisdiction.  Permits shall not be required for the following:

 

(A)  Building:

 

(1) One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 200 square feet (11 18.58 m2).

 

(2) Fences not over 6 feet (1829 mm) high.

(3) Oil derricks.

 

(4) Retaining walls that are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or IIIA liquids.

 

(5) Water tanks supported directly on grade if the capacity does not exceed 5,000 gallons (18 925 L) and the ratio of height to diameter or width does not exceed 2:1.

 

(6) Decks, Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade, and not over any basement or story below and are not part of an accessible route.

 

(7) Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.

 

                        (8) Temporary motion picture, television and theater stage sets and scenery.

 

(9) Prefabricated swimming pools accessory to a Group R-3 occupancy that are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18 925 L) and are installed entirely above ground.

 

(10) Shade cloth structures constructed for nursery or agricultural purposes, not including service systems.

 

(11) Swings and other playground equipment accessory to detached one- and two-family dwellings.

 

(12) Window awnings supported by an exterior wall that do not project more than 54 inches (1372 mm) from the exterior wall and do not require additional support of Group R-3 and U occupancies.

 

(13) Nonfixed and movable fixtures, cases, racks, counters and partitions not over 5 feet 9 inches (1753 mm) in height.

 

(B)  Electrical:

 

(1) Repairs and maintenance: Minor repair work, including the replacement of lamps, ballasts, or luminaires, or the connection of approved portable electrical equipment to approved permanently installed receptacles.

 

(2) Radio and television transmitting stations: The provisions of this Article shall not apply to electrical equipment used for radio and television transmissions, but do apply to equipment and wiring for a power supply and the installations of towers and antennas.

 

(3) Temporary testing systems: A permit shall not be required for the installation of any temporary system required for the testing or servicing of electrical equipment or apparatus.

 

(4) Listed cord-and-plug connected temporary decorative lighting.

 

(5) Reinstallation of attachment plug receptacles but not the outlets therefor.

 

(6) Replacement of branch circuit overcurrent devices of the required capacity in the same location.

 

(7) Electrical wiring, devices, appliances, apparatus or equipment operating at less than 25 volts and not capable of supplying more than 50 watts of energy.

 

(C) Gas:

 

(1)  Portable heating appliance.

 

(2)  Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.

 

(D) Mechanical:

 

(1) Portable heating appliance.

 

(2) Portable ventilation equipment.

 

(3) Portable cooling unit.

 

(4) Steam, hot or chilled water piping within any heating or cooling equipment regulated by this Article.

 

(5) Replacement of any part that does not alter its approval or make it unsafe.

 

(6) Portable evaporative cooler.

 

(7) Self-contained refrigeration system containing 10 pounds (5 kg) or less of refrigerant and actuated by motors of 1 horsepower (746 W) or less.

 

(8) A part or assembly shall include compressor units and evaporator coils (Ord. 7733) for refrigeration equipment.

 

(9) Mechanical service work.

 

(E) Plumbing:

 

(1) The stopping of leaks in drains, water, soil, waste or vent pipe, provided, however, that if any concealed trap, drain pipe, water, soil, waste or vent pipe becomes defective and it becomes necessary to remove and replace the same 20 feet or more with new material, such work shall be considered as new work and a permit shall be obtained and inspection made as provided in this Article.

 

(2) The clearing of stoppages or the repairing of leaks in pipes, valves or fixtures and the removal and reinstallation of water closets, provided such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures.

 

Section 9.  Chapter V, Article 1, Section 5-176 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-176  SCHEDULE OF PERMIT FEES.

On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

Section 10.  Chapter V, Article 1, Section 5-189 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-189  FIRE- AND SMOKE-RESISTANT PENETRATIONS.RESISTANCE-RATED CONSTRUCTION INSPECTION.

Where fire-resistance-rated construction is required between dwelling units or due to location on property, the building official shall require an inspection of such construction after all lathing and/or wallboard is in place, but before any plaster is applied, or before wallboard joints and fasteners are taped and finished.Protection of joints and penetrations in fire-resistance-rated assemblies, smoke barriers and smoke partitions shall not be concealed from view until inspected and approved.

 

Section 11.  Chapter V, Article 1, Section 5-1.200.2 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-1.200.2   USE AND OCCUPANCIES OF BUILDINGS OR STRUCTURES WITH FLOOR AND ROOF DESIGN LOADS EXCEEDING 50 PSF.

Where the live loads for which each floor or portion thereof of a commercial or industrial building is or has been designed to exceed 50 psf (2.40kN/m2), such design live loads shall be conspicuously posted by the owner in that part of each story in which they apply, using durable signs.  It shall be unlawful to remove or deface such notices.

 

A certificate of occupancy shall not be issued until the floor load signs have been installed.

 

It shall be unlawful to place, or cause or permit to be placed, on any floor or roof of a building, structure or portion thereof, a load greater than is permitted by Chapter V, Article 2, Building Code.

 

Section 12.  Chapter V, Article 2, Section 5-201 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-201  BUILDING CODE INCORPORATED.

The International Building Code, 20069 Edition, published by the International Code Council, is hereby adopted by reference as if it were fully set out in this article, except for those portions that are hereinafter deleted, modified or amended.

 

Section 13.  Chapter V, Article 2, Section 5-202 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-202  SAME.

Not less than one (1) copy of the International Building Code, 20069 Edition, marked or stamped in the manner provided by K.S.A. 12-3010, with all sections or portions thereof intended to be omitted clearly marked and showing portions that are amended and to which shall be attached a copy of amendments, shall be filed with the City Clerk and shall be open to inspection and available to the public at reasonable business hours.  Official copies of such Code shall be supplied at the cost of the City to the officials and agencies in the manner listed and set forth in K.S.A.12-3010.  Subsequent references to the "International Building Code" shall mean the "International Building Code 20069 Edition” as adopted herein.

 

Section 14.  Chapter V, Article 2, Section 5-203 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-203  SEVERABILITY.

If any section, clause, sentence, or phrase of this Article ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this Article ordinance .

 

Section 15.  Chapter V, Article 2, Section 5-204 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-204  Amendments Made to the International Building Code, 20069  Edition.

The International Building Code, 20069 Edition is amended or changed as follows.  The amendment of any section shall not serve to amend or repeal any other discretely numbered provision of the code, whether or not such provision is considered a section or subsection, unless that section or subsection is specifically referenced in the ordinance.

 

Section 16.  Chapter V, Article 2, Section 5-204.1 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-204.1  C100 Appendix C of the International Building Code is hereby specifically adopted.

 

Appendices adopted.  The following appendices are hereby specifically adopted as part of the International Building Code:

 

(A)  C100 Appendix C of the International Building Code.

(B)  H100 Appendix H of the International Building Code.

(C)  I100 Appendix I of the International Building Code.

 

 

Section 17.  Chapter V, Article 2, Section 5-204.2 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-204.2         G100 Appendix G of the International Building Code is hereby specifically adopted

Chapter 1 of the International Building Code is hereby deleted.

 

Section 18.  Chapter V, Article 7, Section 5-701 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-701  FUEL GAS CODE INCORPORATED.

The International Fuel Gas Code, 20069 Edition, published by the International Code Council, is hereby adopted by reference as if it were fully set out in this article, except for those portions that are hereinafter deleted, modified or amended.

 

Section 19.  Chapter V, Article 7, Section 5-702 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-702  SAME.

Not less than one (1) copy of the International Fuel Gas Code, 20069 Edition, marked or stamped in the manner provided by K.S.A. 12-3010, with all sections or portions thereof intended to be omitted clearly marked and showing portions that are amended and to which shall be attached a copy of amendments, shall be filed with the City Clerk and shall be open to inspection and available to the public at reasonable business hours.  Official copies of such Code shall be supplied at the cost of the City to the officials and agencies in the manner listed and set forth in K.S.A.12-3010.  Subsequent references to the "International Fuel Gas Code" or "Standard Code" shall mean the "International Fuel Gas Code, 20069 Edition”, as adopted herein. 

 

Section 20.  Chapter V, Article 7, Section 5-703 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-703  SEVERABILITY.

If any section, clause, sentence, or phrase of this Article ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this Article ordinance .

 

Section 21.  Chapter V, Article 7, Section 5-704 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-704 AMENDMENTS MADE TO THE INTERNATIONAL FUEL GAS CODE, 20069 EDITION.

The International Fuel Gas Code is amended or changed as follows.  The amendment of any section shall not serve to amend or repeal any other discretely numbered provision of the code, whether or not such provision is considered a section or subsection, unless that section or subsection is specifically referenced in the ordinance.

 

Section 22.  Chapter V, Article 7, Section 5-705 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-705  Chapter 1 of the International Fuel Gas is hereby deleted.

 

Section 23.  Chapter V, Article 7, Section 5-706 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-706  Section 303.3 of the International Fuel Gas Code is hereby amended to read as follows:

 

303.3  Prohibited locations.  Appliances shall not be located in sleeping rooms, bathrooms, toilet rooms, hot tub rooms, storage closets or surgical rooms, or in a space that opens only into such rooms or spaces, except where the installation complies with one of the following:

 

1.    The appliance is a direct-vent appliance installed in accordance with the conditions of the listing and the manufacturer’s instructions.

 

2.       Vented room heaters, wall furnaces, vented decorative appliances, vented gas fireplaces, vented gas fireplace heaters and decorative appliances for installation in vented solid fuel-burning fireplaces are installed in rooms that meet the required volume criteria of Section G2407.5.

 

3.       Unvented appliances may be installed in rooms other than those listed above provided at least one carbon monoxide detector is installed in the dwelling unit.  A single wall-mounted unvented room heater is installed in a bathroom and such unvented room heater is equipped as specified in Section G2445.6 and has an input rating not greater than 6,000 Btu/h (1.76 kW). The bathroom shall meet the required volume criteria of Section G2407.5.

 

4.  A single wall-mounted unvented room heater is installed in a bedroom and such unvented room heater is equipped as specified in Section G2445.6 and has an input rating not greater than 10,000 Btu/h (2.93 kW). The bedroom shall meet the required volume criteria of Section G2407.5.

 

4.       The appliance is installed in a room or space that opens only into a bedroom or bathroom, and such room or space is used for no other purpose and is provided with a solid weather-stripped door equipped with an approved self-closing device.  All combustion air shall be taken directly from the outdoors in accordance with Section G2407.6.

 

Section 24.  Chapter V, Article 7, Section 5-707 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-707  Section 406.4 of the International Fuel Gas Code and the indicated subsections are hereby amended to read as follows:

 

406.4 Test pressure measurement.  Test pressure shall be measured with a manometer or with a pressure-measuring device designed and calibrated to read, record, or indicate a pressure loss caused by leakage during the pressure test period.  The source of pressure shall be isolated before the pressure tests are made.  Mechanical gauges used to measure test pressures shall have a range such that the highest end of the scale is not greater than five times the test pressure.

 

406.4.1  Test pressure.  The test pressure to be used shall be no less than 1½ times the proposed maximum working pressure, but not less than 3 10 psig (20 kPa gauge), irrespective of design pressure.  Where the test pressure exceeds 125 psig (862 kPa gauge), the test pressure shall not exceed a value that produces a hoop stress in the piping greater than 50 percent of the specified minimum yield strength of the pipe.

 

406.4.2  Test duration.  Test duration shall be not less than ½ hour for each 500 cubic feet (14 m3) of pipe volume or fraction thereof.  When testing a system having a volume less than 10 cubic feet (0.28 m3) or a system in a single-family dwelling, the test duration shall be not less than 10 minutes.  The duration of the test shall not be required to exceed 24 hours.

 

Section 25.  Chapter V, Article 8, Section 5-801 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-801  ENERGY CONSERVATION CODE INCORPORATED.

The International Energy Conservation Code, 20069 Edition, published by the International Code Council, is hereby adopted by reference as if it were fully set out in this article, except for those portions that are hereinafter deleted, modified or amended.

 

Section 26.  Chapter V, Article 8, Section 5-802 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-802  SAME.

Not less than one (1) copy of the International Energy Conservation Code, 20069 Edition, marked or stamped in the manner provided by K.S.A. 12-3010, with all sections or portions thereof intended to be omitted clearly marked and showing portions that are amended and to which shall be attached a copy of amendments, shall be filed with the City Clerk and shall be open to inspection and available to the public at reasonable business hours.  Official copies of such Code shall be supplied at the cost of the City to the officials and agencies in the manner listed and set forth in K.S.A.12-3010.  Subsequent references to the "International Energy Conservation Code" shall mean the "International Energy Conservation Code, 20069 Edition” as adopted herein.

 

Section 27.  Chapter V, Article 8, Section 5-803 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-803   SEVERABILITY.

If any section, clause, sentence, or phrase of this Article ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this Article ordinance .

 

Section 28.  Chapter V, Article 8, Section 5-804 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-804  AMENDMENTS MADE TO THE INTERNATIONAL ENERGY CODE, 20069 EDITION.

The International Energy Conservation Code, 20069 Edition is amended or changed as follows.  The amendment of any section shall not serve to amend or repeal any other discretely numbered provision of the code, whether or not such provision is considered a section or subsection, unless that section or subsection is specifically referenced in the ordinance.

 

Section 29.  Chapter V, Article 8, Section 5-805 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-805  Section 401.2 of the International Energy Conservation Code and its referenced subsections is hereby amended to read as follows:

 

          401.2  Compliance.  Projects shall comply with Sections 401, 402.4, 402.5, and 403 403.1, 403.2.2, 403.2.3, and 403.3 through 403.9 (referred to as the mandatory provisions) and either:

 

1.    Sections 402.1 through 402.3, 403.2.1 and 404.1 (prescriptive); or

 

2.    Section 405 (performance).

 

3.    Where compliance is obtained using the Home Energy Rating system the energy rating shall be performed in accordance with the Mortgage Industry National Home Rating Systems Accreditation Standard by a rater certified and listed by the Residential Energy Services Network (RESNET).  Approval from the Building Official to utilize the Home Energy Rating as a means of demonstrating compliance with this chapter shall be obtained prior to the issuance of a building permit.  A Home Energy Rating Systems score of 80 or higher shall be deemed to be in compliance with this chapter.

 

Section 30.  Chapter V, Article 8, Section 5-806 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-806  Section 402.1.1 of the International Energy Conservation Code is hereby amended to read as follows:

 

402.1.1  Insulation and fenestration criteria.  The building thermal envelope shall meet the requirements of Table 402.1.1 based on the climate zone specified in Chapter 3.

a.       R -values are minimums.  U -factors and SHGC are maximums.  R-19 batts compressed into a nominal 2 × 6 framing cavity such that the R -value is reduced by R-1 or more shall be marked with the compressed batt R -value in addition to the full thickness R -value. 

b.       The fenestration U -factor column excludes skylights.  The SHGC column applies to all glazed fenestration. 

c.       "15/19" means R-15 continuous insulated sheathing on the interior or exterior of the home or R-19 cavity insulation at the interior of the basement wall.  "15/19" shall be permitted to be met with R-13 cavity insulation on the interior of the basement wall plus R-5 continuous insulated sheathing on the interior or exterior of the home.  "10/13" means R-10 continuous insulated sheathing on the interior or exterior of the home or R-13 cavity insulation at the interior of the basement wall. 

d.       R-5 shall be added to the required slab edge R -values for heated slabs.  Insulation depth shall be the depth of the footing or 2 feet, whichever is less in Zones 1 through 3 for heated slabs. 

e.       There are no SHGC requirements in the Marine Zone. 

f.        Basement wall insulation is not required in warm-humid locations as defined by Figure 301.1 and Table 301.1. 

g.       Or insulation sufficient to fill the framing cavity, R-19 minimum. 

h.       "13+5" means R-13 cavity insulation plus R-5 insulated sheathing.  If structural sheathing covers 25 percent or less of the exterior, insulating sheathing is not required where structural sheathing is used.  If structural sheathing covers more than 25 percent of exterior, structural sheathing shall be supplemented with insulated sheathing of at least R-2. 

i.        The second R -value applies when more than half the insulation is on the interior of the mass wall. 

j.        For impact rated fenestration complying with Section R301.2.1.2 of the International Residential Code or Section 1608.1.2 of the International Building Code, the maximum U -factor shall be 0.75 in Zone 2 and 0.65 in Zone 3.

k.       Slab edge insulation may be eliminated for slab on grade floors when the building’s heating systems efficiency rating is 90% or better.

 

 

 

 

Section 31.  Chapter V, Article 9, Section 5-901 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-901  EXISTING BUILDING CODE INCORPORATED.

The International Existing Building Code, 20069 Edition, published by the International Code Council, is hereby adopted by reference as if it were fully set out in this article, except for those portions that are hereinafter deleted, modified or amended.

 

Section 32.  Chapter V, Article 9, Section 5-902 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-902  SAME.

Not less than one (1) copy of the International Existing Building Code, 20069 Edition, marked or stamped in the manner provided by K.S.A. 12-3010, with all sections or portions thereof intended to be omitted clearly marked and showing portions that are amended and to which shall be attached a copy of amendments, shall be filed with the City Clerk and shall be open to inspection and available to the public at reasonable business hours.  Official copies of such Code shall be supplied at the cost of the City to the officials and agencies in the manner listed and set forth in K.S.A.12-3010.  Subsequent references to the "International Existing Building Code" shall mean the "International Existing Building Code, 20069 Edition” as adopted herein.

                            

Section 33.  Chapter V, Article 9, Section 5-903 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5- 903  SEVERABILITY.

If any section, clause, sentence, or phrase of this Article ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this Article ordinance .

 

Section 34.  Chapter V, Article 9, Section 5-904 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby amended and shall read as follows:

 

5-904  AMENDMENTS MADE TO THE INTERNATIONAL EXISTING BUILDING CODE, 2006 9 EDITION.

The International Existing Building Code, 20069 Edition is amended or changed as follows.  The amendment of any section shall not serve to amend or repeal any other discretely numbered provision of the code, whether or not such provision is considered a section or subsection, unless that section or subsection is specifically referenced in the ordinance.

 

Section 35.  Chapter V, Article 9, Section 5-905 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, is hereby enacted and shall read as follows:

 

5-905 Sections 102 through and including Section 117 of the International Existing Building Code are hereby deleted. 

 

Section 36.  Existing Chapter V, Article 1, Sections 5-1.242, 5-1.243, 5-1.244, 5-1.245, 5-1.246, 5-1.247, 5-1.248, 5-1.249 , 5-1.250, 5-1.251; and 5-1.252; Chapter V, Article 2, Sections 5-204.3, 5-204.4, 5-204.5 and 5-205; Chapter V, Article 7, Sections 5-704.1, 5-704.2, and 5-704.3; Chapter V, Article 8, Sections 5-804.1, 5-804.2, and 5-804.3;  and Chapter V, Article 9, Sections 5-904.1, 5-904.2, 5-904.3, 5-904.4, 5-940.5, 5-904.6,5 -904.7, 5-904.8, 5-904.9, 5-904.10, 5-904.11, 5-904.12, 5-904.13,  5-904.14, 5-904.15 and 5-904.16 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, are hereby repealed.

 

Section 37.  Existing Chapter V, Article 1, Sections 5-101, 5-109, 5-110, 5-111, 5-112, 5-115, 5-128, 5-144, 5-176, and 5-189; Chapter V, Article 2, Sections 5-201, 5-202, 5-203, 5-204, 5-204.1, and 5-204.2; Chapter V, Article 7, Sections 5-701, 5-702, 5-703, and 5-704; Chapter V, Article 8, Sections 5-801, 5-802, 5-803, and 5-804; and Chapter V, Article 9, Sections 5-901, 5-902, 5-903, and 5-904 of the Code of the City of Lawrence, Kansas 2009 Edition, and amendments thereto, are hereby repealed it being the intent of this ordinance to supercede the repealed code provisions.  

 

Section 38.   SEVERABILITY.

If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

 

Section 39.  This Ordinance shall take effect and be in full force on and after January 1, 2011 and upon its passage and publication as provided by law.
