FIRST AMENDMENT TO
MEMORANDUM OF UNDERSTANDING
BETWEEN THE
CITY OF LAWRENCE, KANSAS
AND THE
LAWRENCE POLICE OFFICERS ASSOCIATION (LPOA)
January 1, 2010 through December 31, 2011
General Statement of Intent of this First Amendment: The City and representatives of the Lawrence Police Officers Association (“LPOA”) and representatives of the International Association of Firefighters, Local 1596 (“IAFF”) have met separately to discuss 2011 compensation issues for the employee organizations’ members in accordance with the LPOA and IAFF’s respective 2010-2011 Memoranda of Understanding and in accordance with Resolution No. 6817. The LPOA and the IAFF have put forth separate proposals that contain different compensation enhancements for their members for 2011. The LPOA and the City desire to acknowledge the parties’ intent and understanding with respect to the LPOA’s 2011 compensation proposal as it relates to Section 3.2 of the Memorandum of Understanding Between the City of Lawrence, Kansas and the Lawrence Police Officers Association (LPOA), January 1, 2010 through December 31, 2011 (hereinafter the “MOU”).
Therefore, the City and the LPOA agree The Memorandum of Understanding Between the City of Lawrence, Kansas and the Lawrence Police Officers Association (LPOA), January 1, 2010 through December 31, 2011 is hereby amended to read as follows:
Section 3.2 Wage Adjustment
2011 Wages: It is acknowledged that the Revised Pay Plan attached hereto as Exhibit A and incorporated by reference includes a general wage increase (general wage adjustment) of one and one-half percent (1.5%) effective with the first full pay period in 2011 for pay grade 301, Police Officer, only. It is acknowledged that the aforementioned Exhibit A is included as part of the Lawrence, Kansas Police Department Compensation Program for Sworn Personnel, which applies only to police personnel represented by the LPOA. It is understood that the general wage adjustment set forth herein shall not apply to or be paid to pay grade 302, Detective. If during FY 2011, the city institutes a greater general wage adjustment to any City employee, employee group, or bargaining group, during the term of this memorandum, such general wage adjustment shall also be instituted for employees covered by this Agreement. The LPOA and the City agree that during Fiscal Year (FY) 2011, the general wage adjustment for pay grade 301, Police Officer, contained herein and effective in FY2011 shall not and does not constitute “a greater general wage adjustment to any city employee, employee group, or bargaining unit during the term of this Memorandum.” Accordingly, the employees covered by the MOU, other than employees in pay grade 301, Police Officer, shall not receive and the LPOA shall make no claim for such general wage adjustment for Fiscal Year (FY) 2011. The LPOA and the City further acknowledge and agree that during Fiscal Year (FY) 2011, the addition of one step to the IAFF’s 2011 Revised Fire Pay Plan for pay grades F01, F01a, F02, F03, F04, F05, F06, F07, F08, F09 and F10, made pursuant to an Agreement between the IAFF Local 1596 and the City, effective with the first full pay period in 2011, shall not and does not constitute a “greater general wage adjustment to any City employee, employee group, or bargaining unit during the term of this Memorandum.” Accordingly, the employees covered by the MOU between the City and LPOA shall not receive and the LPOA shall make no claim for a comparable revision to the attached Pay Plan for FY 2011.
All other terms of the MOU shall remain unchanged.
