The Sandbar (17 East 8th Street) has submitted the attached temporary use of right-of-way permit application requesting the closure of 8th Street from Massachusetts Street to New Hampshire Street from noon to 1:00 a.m. on Saturday-Sunday, August 14-15, 2010. The Sandbar is planning the establishment’s birthday celebration featuring a street concert, vendors and alcohol sales, possession and consumption in a “beer garden” area adjacent to the establishment. Parking meters would be bagged twenty-four hours in advance of the event and the street would be closed with barricades provided by the city. The attached statement signed by adjacent property owners and occupants has been submitted.
Staff recommends that conditions be added to the permit that the applicant meet any requirements set forth by the Police and Fire Medical departments regarding public safety and access, and that the applicant clean the event area following the event.
The Sandbar is requesting approval for age appropriate birthday celebrants to possess and consume alcoholic beverages in a controlled, fenced 20 X 22 foot area on 8th Street in front of the Sandbar establishment from August 14 at noon to August 15 at 1:00 am. Sandbar staff is working with Alcohol Beverage Control to obtain approval to temporarily extend the existing licensed premises to cover this area for this event. City Code section 4-105(E) allows the City to exempt, by ordinance, specified City property from the prohibition of alcoholic beverages on public property. Ordinance No. 8545 is attached for the Commission’s consideration and would allow possession and consumption of alcoholic liquor in the specified area provided that it is otherwise pursuant to the Code of the City of Lawrence, Kansas and the laws of the State of Kansas.
ACTION: Approve a temporary use of right-of-way-permit for The Sandbar Birthday Party for the closure of 8th Street from Massachusetts Street to New Hampshire Street from noon on Saturday, August 14, 2010 to 1:00 a.m. on Sunday, August 15, 2010, if appropriate.
