ACTION TAKEN

Motioned by Commissioner Wiechert, seconded by Commissioner Marvin, to approve the January 21, 2010 Action Summary.

ITEM NO. 2:         CoMMUNICATIONS

a)    Ms. Braddock Zollner stated there were three letters on the dais for the Commissioners to review regarding 19th and Learnard duplex construction.

 

b)   No declaration of abstentions from specific agenda items by commissioners.   

 

Commissioner Antle stated Item 3 would be moved to the end of the agenda.

 

ITEM NO. 4:        DR-12-151-09      420 Mississippi Street; Demolition and New Construction; Certified Local Government Review. The structure is located in the environs of the Pinckney II Historic District, National Register of Historic Places. Submitted by Ronald D. Lawrenz, the property owner of record.

Ms. Braddock Zollner presented the item.

 

APPLICANT PRESENTATION

Ronald Lawrenz stated the structure was unsafe.  He said the walls were pulling away from the foundation and the structure was falling apart.

 

Commissioner Antle asked Mr. Lawrenz if he read the staff report.

 

Mr. Lawrenz said he could put a window in the master bedroom and the living room.

COMMISSION DISCUSSION

Commissioner Sizemore said horizontal cracks in a basement were not a good thing.

 

ACTION TAKEN

Motioned by Commissioner Antle, seconded by Commissioner Veatch, to approve the demolition project at 420 Mississippi Street with the following conditions:

 

 

1. The applicant provide complete construction documents, with material notations, including window and door details to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

2. Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work;

3. The property owner will allow staff access to the property to photo document the project before demolition, during construction, and upon completion of the project.

 

 

Motion approved unanimously, 5-0


 

ITEM NO. 5:      DR-01-02-10        825-827 Massachusetts Street; Window Replacement & Additions; Certified Local Government Review. The structure is a contributing structure to Lawrence’s Downtown Historic District, National Register of Historic Places. The property is also located in the Downtown Conservation Overlay District. Submitted by Hernly Associates for Blue Cypress, LLC, the property owner of record.

APPLICANT PRESENTATION

Mike Meyers stated the structure would be subdivided for multiple tenant residential use.  He said windows would be added on the south of the structure. 

 

Commissioner Antle asked Mr. Meyers if he had submitted the tax credit application to the state.

 

Mr. Myers said he had applied for tax credits but had not heard back from the state.

 

Commissioner Wiechert asked the applicant if the windows were being installed to let natural light in the building.

 

Mr. Meyers said the windows were being installed to allow for light.

COMMISSION DISCUSSION

Commissioner Marvin asked Mr. Meyers if the windows would have multiple panes.

 

Mr. Myers said there were 52 windows in the 1954 photo of the structure.  He said he was proposing only twenty windows due to the large cost.

 

Commissioner Antle asked Staff to explain the staff recommendations.

 

Ms. Braddock Zollner said the original approval for the project had changes and the final construction documents were reviewed by the Architectural Review Committee instead of the Historic Resources Administrator.

 

Commissioner Sizemore said there was no reason the project would need to go to the Architectural Review Committee.

 

 

 

 

 

 

 

 

ACTION TAKEN

Motioned by Commissioner Veatch, seconded by Commissioner Wiechert, to approve the window replacement and addition for the project at 825-827 Massachusetts Street with the following conditions:

 

1. The applicant provide complete final construction documents, with material notations, including window details, to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

2. Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work;

3. The property owner will allow staff access to the property to photo document the project before demolition, during construction, and upon completion of the project.

ITEM NO. 6:      DR-01-03-10        1225 Tennessee Street; Replacement Addition; Certified Local Government Review. The property is located in the environs of the Oread Historic District, National Register of Historic Places. Submitted by Gordon Sailors and Paula Kellogg for Rose M Moore, property owner of record.

Ms. Braddock Zollner presented the item.

 

APPLICANT PRESENTATION

Gordon Sailors stated he would replace the foundation in the rear of the house and add a crawl space.  He said he would remove the additions and replace water lines and waste lines.

 

Commissioner Wiechert asked the applicant if the foundation was stone.

 

Mr. Sailors said the foundation was stone and he did not know when the additions were added to the structure.

COMMISSION DISCUSSION

Commissioner Antle asked if both additions were on the crumbling slab.

 

Mr. Sailors said it looked like the additions were added at separate times.

 

Ms. Braddock Zollner said it looked like it was a porch that was enclosed and a second story sleeping area was built above.

 

ACTION TAKEN

Motioned by Commissioner Veatch, seconded by Commissioner Marvin to approve the replacement addition project at 1125 Tennessee Street with the following conditions:

 

1. The applicant provide complete construction documents, with material notations, including window and door details to be reviewed and approved by the Historic Resources Administrator prior to release of a building permit;

2. Any changes to the approved project will be submitted to the Historic Resources Commission prior to the commencement of any related work;

3. The property owner will allow staff access to the property to photo document the project before demolition, during construction, and upon completion of the project.

ITEM NO. 7:  Chapter 11 Historic Resources, Horizon 2020 The Comprehensive Plan for Lawrence and Unincorporated Douglas County

 

STAFF PRESENTATION

Ms. Braddock Zollner presented the item.

 

Commissioner Antle asked Ms. Braddock Zollner if the tax credits were still viable.

 

Ms. Braddock Zollner said there were several bills but neither bill had passed yet.  She said she hoped the program would come back the way it had been previously.

 

Commissioner Marvin said the goal for the heritage tourism section needed to be updated.  She said the 2nd section regarding the black jack battle field was not necessary.  Commissioner Marvin stated she performed paid contract work for the battle field trust group.

 

Commissioner Wiechert said some of the goals in the document had been accomplished.

 

Ms. Braddock Zollner said leaving the goals in the Comprehensive Plan document was a very good idea.

 

Commissioner Antle asked if salvage encouragement was in the document.  He said a clause promoting the reuse of historic materials should be added.

 

Commissioner Marvin said recycling materials from deconstructed buildings should be seen as sustainability.

 

Ms. Braddock Zollner said she sent an email to the Commission regarding sustainability and seeking input.

 

Commissioner Antle said it would be simple to put in principals regarding historic preservation.

 

Ms. Braddock Zollner asked if there were other issues that should be addressed.

 

PUBLIC COMMENT

Dale Nimz, Executive Director of Kansas Preservation Alliance, stated the preservation situation outside of Lawrence had not improved since 2003.  He said the plan was an important effort to manage preservation and make it better for the future.  He said the preservation plan could be a model for the state of Kansas.

 

Ms. Braddock Zollner said if the Commission had questions about the plan Mr. Nimz could probably answer them.

 

Mr. Nimz stated there had been public workshops held in the past.

 

Ms. Braddock Zollner said she was looking for direction from the Commission.   She said this was the first review since 2005 and the document could be found on the City’s website.


 

 

ITEM NO. 3:        DR-12-149-09      1120 Rhode Island Street; Demolition of Accessory Structure; Certified Local Government Review.  The property is a contributing structure to the North Rhode Island Historic District, National Register of Historic Places.  Submitted by Tenants to Homeowners for the Board of County Commissioners of Douglas County, Kansas, the property owner of record.

 

STAFF PRESENTATION

Ms. Kirchhoff presented the item.

 

Ms. Braddock Zollner said Staff, the Codes Department, and the Lawrence Preservation Alliance reviewed the structure to see what it would need to become code compliant.

 

APPLICANT PRESENTATION

Mike Goans stated he represented the Lawrence Preservation Alliance and Tenants to Homeowners.  He said he was putting together a proposal to remove the south portion of the structure and he would repair and stabilize the building so it could continue to be used. 

 

Rebecca Buford said she did not want to demolish the structure.  She said she would contribute $4,600.00 to restore the structure.

 

Mr. Goans stated the Lawrence Preservation Alliance board supported the project and would like to proceed.

 

Commissioner Sizemore asked Mr. Goans what the anticipated cost was for restoration.

 

Mr. Goans stated with tax credits the rehabilitation cost would be $4,600.00.

 

Ms. Braddock Zollner said the applicant could withdraw the demolition request, or the Commission could deny the request.  She said the Commission could approve the demolition with a combination of conditions.  Ms. Braddock Zollner stated if the demolition request was not withdrawn, the Commission would need to take action on the request.

 

Commissioner Marvin said if the Commission denied the request it would appear there was not a cooperative effort and a solution had been worked out.

 

Commissioner Veatch stated the applicant could withdraw the request or it could be denied by the Commission.

 

Commissioner Antle stated he would be comfortable with approving the demolition as long as rehabilitation was attempted prior to the demolition.  He said he was comfortable with Staff making the final determination.

 

Commissioner Wiechert asked what type of new structure would replace the old one.

 

Ms. Braddock Zollner stated the applicant submitted the plans for a new structure at the January Historic Resources Commission meeting.

 

Ms. Buford stated there was no guarantee the rehabilitation would be completed.  She said there was a possibility there would not be enough funds.

 

Mr. Goans said the demolition permit should be tabled for thirty days.

 

Ms. Buford said she would feel comfortable with tabling the demolition for a month.

ACTION TAKEN

Motioned by Commissioner Antle, seconded by Commissioner Veatch, to table the demolition request for 1120 Rhode Island Street to March 25th, 2010.

 

Motion approved unanimously, 5-0

 

ITEM NO. 8:      MISCELLANEOUS MATTERS

DR-01-04-10        645-647 Massachusetts Street; Elevator Addition; Certified Local Government Review. The structure is located in the environs of the Eldridge Hotel (701 Massachusetts), the United States Post Office (645 New Hampshire), and Lawrence’s Downtown Historic District, National Register of Historic Places. The structure is also located in the environs of the House Building (729-731 Massachusetts), Kansas Register of Historic Places and is located in the Downtown Conservation Overlay District. Submitted by Paul Werner Architects for GCB Holdings LC, the property owners of record.

DR-01-05-10        1029 Massachusetts Street; MEP Addition; Certified Local Government Review. The property is listed as a contributing structure to Lawrence’s Downtown Historic District, National Register of Historic Places. The property is also located in the Downtown Conservation Overlay District. Submitted by Asif Jiwani for First Management Inc, the property owner of record.

 

ACTION TAKEN

Motioned by Commissioner Veatch, seconded by Commissioner Wiechert to confirm the Administrative Reviews.

 

                                      Motion approved unanimously, 5-0

 

D.   Mr. Brown said 1120 Rhode Island Street and the Ohio Street property were contributing properties.  He said they were originally built as single family dwellings, became apartments and then boarding houses.  He said the Historic Resources Commission should have asked if the structures were reversible back to a single family residence.

 

Ms. Braddock Zollner said if the foot print of an addition to a structure was less than twenty percent of the footprint of the structure it would be reviewed administratively.

 

E. Commissioner Veatch asked Ms. Braddock Zollner if there were replacements for Commissioner Sizemore and Commissioner Antle due to their terms expiring.

 

Ms. Braddock Zollner stated the Mayor had not appointed anyone to the two open Commission seats.

 

(1)  Ms. Braddock Zollner stated the first Thursday of each month would be scheduled for the Architectural Review Committee meeting date.  She said the dates for submittal deadlines for Historic Resources Commission had changed and was available on line.

(2)  Ms. Braddock Zollner said there would be a training session for the Certified Local Government Annual Report.

(3) Ms. Braddock Zollner stated the March Historic Resources Commission meeting will be moved to the 25th of March and will be held at Fire station #5.

(4) Ms. Braddock Zollner stated the applicant for the 19th and Learnard Street project was appealing the decision of the Historic Resources Commission.
