RE:	1804 W 6th Street (SP-03-13-10) Variance request from City Code 19-214(B)

Please include the following item on the City Commission agenda for consideration at the May 25, 2010 meeting:

Approval of the attached request by Bartlett and West, on behalf of the owner of the property at 1804 W. 6^th Street, Johnson & Ellis Investments, for a variance from 19-214B of the City Code which states that a private sanitary sewer service line shall not be located in a City public right of way for greater than 15 feet. 

Johnson & Ellis Investments, the property owner of 1804 W. 6^th Street, recently submitted a site plan application to construct a building addition to Jayhawk Pawn and Jewelry building along with updated parking lots, lighting, and other site amenities. The building’s existing sanitary sewer service line connects to the public sanitary sewer main located approximately 35 feet into the Colorado Street right of way. While the service line will not be modified as part of the current redevelopment the requested variance does bring the property into compliance with the current code.

Action Request. Department of Utilities staff requests the City Commission’s approval of the requested variance from 19-214B of the code for 1804 W. 6^th Street.
