Vacation of Unoccupied Utility Easement

Please include the following item on the City Commission regular agenda for consideration at the May 4, 2010 meeting:

On May 4, 2010 the City Commission will open a public hearing to consider a request by City of Lawrence, 6 E. 6th Street, Lawrence, Kansas 66049, for the vacation of an unoccupied utility easement located off of 9th Street.

The City of Lawrence is the owner of Lot 2 of the Downtown 2000 Addition Plat.  A 10 ft. utility easement was identified on the north of Lot 2.  The City entered into an agreement with 9-10, L.C. in October 2000 to allow the highlighted area (see attachment) to be used by 9-10, L.C.  for an outside courtyard/seating area.

9-10, L.C. is currently looking to develop their Lot 1.  Their plan includes the use of the highlighted area for the agreed to courtyard/seating.  The easement is not being used.

All utilities, as well as city staff, have reviewed this request and have no objections.  All property owners within 200 feet have also been notified and no objections have been received.

 

Action Requested:     Hold public hearing and, pending discussion, approve order of vacation.
