RE:	Renewal of the City – KU Land Use Agreement

In April 2005, the City and the University of Kansas entered into a cooperation agreement which specifies the City land use regulations the University shall comply with in its ownership and use of University real property within City boundaries.  A task force appointed by the City’s Mayor and KU’s Chancellor crafted the agreement after much deliberation.  A copy of the Agreement and a brief description of its major provisions are attached.  Since its adoption, the Agreement has worked to balance the interests of the City and the University on a number of projects.

The Agreement renews for another five-year term in the absence of one party giving notice of intent to terminate the Agreement.  University representatives have expressed the University’s desire to continue the Agreement.     

In January 2010, City staff and representatives from the University participated in a public forum on the Agreement with representatives of effected neighborhood associations.   Persons attending the public meeting expressed a desire to continue the Agreement.     

Staff recommends the City Commission acknowledge the extension of the Agreement, in its current form, for another five-year term.
