RESOLUTION NO.  6880

A RESOLUTION ADOPTING THE DECISION OF THE COMMUNITY DEVELOPMENT ADVISORY COMMITTEE AND FINDING BLIGHTED CONDITIONS AT 331 JOHNSON AVENUE, LAWRENCE, KANSAS.

WHEREAS, the Enforcing Officer has, in accordance with the provisions of Chapter 9, Article 6 of the City Code of Lawrence, Kansas, 2009 Edition and amendments thereto, cited the property owner of 331 Johnson Avenue for violations of City Code Sections 9-606.1 (A) and (C) which prohibits the storage of junk/refuse and personal property on porches.   

          WHEREAS, the provisions of City Code, Section 9-607 provides the owner of a property for which is cited the right to request a hearing within 15 days before the Community Development Advisory Committee. 

WHEREAS, the owner requested a hearing and after numerous cancellations by the owner, the Committee members unanimously voted 7-0 to proceed with the hearing as scheduled on December 10, 2009 without the owner present.

          WHEREAS, the Committee members heard evidence which included testimony and pictures presented by the enforcing officer and unanimously voted 7-0 that the property owner was in violation of City Code Sections 9-606.1 (A) and (C).

          WHEREAS, pursuant to the provisions of Section 9-611, the Community Development Advisory Committee recommends adopting the resolution confirming the property owner is in violation of Sections 9-606.1 (A) and (C) of the Code of the City of Lawrence.

          NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1.  The property located at 331 Johnson Avenue within the City of Lawrence, Kansas is found to be in violation of subsections (A) and (C) of Section 9-606.1 of the Code of the City of Lawrence, 2009 edition, and amendments thereto based upon the following conditions, to wit:

Section 2.  That the decision of the Community Development Advisory Committee is hereby adopted as the decision of the City Commission.

Section 3.  That this resolution shall be served upon the record owner of the subject property in manner that is specified in Section 9-609 of the Code of the City of Lawrence, 2009 edition, and amendments thereto.
