RESOLUTION NO. 6879
A RESOLUTION FIXING A TIME AND PLACE FOR A HEARING PURSUANT TO THE PROVISIONS OF K.S.A. 12-1750, ET SEQ. AND CHAPTER 5, ARTICLE 11, OF CODE OF THE CITY OF LAWRENCE, KANSAS, 2009 EDITION AND AMENDMENTS THERETO; WHEREAS PERSONS HAVING AN INTEREST IN CERTAIN NAMED STRUCTURES MAY APPEAR AND SHOW CAUSE WHY SUCH STRUCTURES SHOULD NOT BE CONDEMNED AND ORDERED REPAIRED OR DEMOLISHED AS UNSAFE OR DANGEROUS STRUCTURES.
WHEREAS, The Enforcing Officer has, in accordance with the provisions of K.S.A. 12-1750 et seq., and Chapter 5, Article 11 of Code of the City of Lawrence, Kansas, 2009 Edition and amendments thereto, filed with the Governing Body of the City a statement in writing that certain structures located on the following described premises in the City of Lawrence, Douglas County, Kansas, to-wit:
STEELE’S SUB OF BLKS 6-8-9-10E ARL’S ADD BLK 8 LT 9 & N 15FT LOT 10 (UO2632 & 33 COMBINED 1988), commonly known as 1313 Haskell Avenue
are unsafe or dangerous;
WHEREAS, the provisions of said statutes require that, upon the filing of such a statement with the Governing Body of the City, said Governing Body shall fix a time and place at which the owner, his agent, any lien holders of record and any occupant of such structures may appear and show cause why such structures should not be condemned and ordered repaired or demolished; and
WHEREAS, proceeding under such statutes may ultimately result in accomplishment of repair or demolition by the City of Lawrence, Kansas, the owner’s loss of all rights in the salvage to the extent of the costs of such repair or demolition, and an assessment against the real property for said costs in excess of the value of the salvage.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
Section One: That pursuant to the provisions of K.S.A. 12-1750 et seq., a hearing will be held in the City Commission Room, first floor, 6 E. 6th Street, Lawrence, Kansas, May 18, 2010, at 6:35pm, or as soon thereafter as the matter may be heard at which time and place the owner, his agent, any lien holders of record and any occupant of the structures located on the following premises in the City of Lawrence, Douglas County, Kansas, to-wit:
STEELE’S SUB OF BLKS 6-8-9-10E ARL’S ADD BLK 8 LT 9 & N 15FT LOT 10 (UO2632 & 33 COMBINED 1988), commonly known as 1313 Haskell Avenue
may appear and show cause why such structures should not be condemned and ordered repaired or demolished. The structures are the principal dwelling unit and the accessory building (garage) on the legally described property.
Section Two: The City Clerk is hereby authorized to provide for publication, once each week for 2 consecutive weeks on the same day of each week, in the official newspaper of the City, the Resolution setting the hearing date and time.
