Vacation of Easements - Briarwood Addition

Public Hearing – January 26, 2010 City Commission

 

Attached is a request to vacate an easement that allows utility, pedestrian and vehicular access in the Briarwood Addition (see attached map).  The applicants include Pamela P. Mayfield, Mike Polk, Nancy L. Borer, Steven J. and Stephanie S. Freeman.  The applicants are requesting the vacation because they believe full public access is a safety and security issue.

 

Attached is a memo from Scott McCullough outlining the history of this easement, and current traffic counts performed by the Traffic Division. 

 

The applicants have already signed an easement back to the City allowing utility, pedestrian and emergency access.  Therefore, vacation and rededication solely restricts full public (vehicle) access. 

 

Notice was provided to all residents within the Briarwood Addition.  Staff has received several calls from concerned residents about a second emergency access; however, this type of access will be available through the dedication of a new easement.  All utilities have been contacted and no objections were received.  The Fire Department is okay with the new easement.

 

Action Request:

Hold public hearing and, pending public comment, approve Order of Vacation conditioned upon the rededication of a new easement allowing utility, pedestrian, and emergency access.
