Amendment to Chapter 16, Article 12, Access Management Requirements for West 6th Street.

 

On January 5, 2010, the City Commission accepted the dedication of easements and rights of way for Preliminary Plat (PP-10-5-09) for a four lot commercial and residential-office subdivision  on approximately 29 acres for the Mercato project located at the NE corner of K-10 & West 6th Street (Hwy 40).  The revised preliminary plat included a westbound right-in-only and right-out-only access point on the north side of West 6th Street between George Williams Way and K-10 highway. 

 

On January 5, 2010, the City Commission was also presented with an amendment to Section 16-1201 of the City Code pertaining to Access Management Requirements for West 6th Street. Staff’s opinion is that the City Code must be amended in order for the Mercato project to gain the right-in-only and right-out-only access on West 6th Street.  

 

The amendment to Section 16-1201 would give the City the authority to allow the westbound right-in-only and right-out-only access point on the north side of West 6th Street between George Williams Way and K-10 highway subject to approval by the City and the Kansas Department of Transportation.  The current frontage road allowed by code would be closed and replaced with the new 6th Street access.

 

The City Commission directed Staff to place the proposed ordinance on the January 12, 2010 City Commission agenda for consideration. 

 

Action Requested: Receive and, if appropriate, adopt on first reading Ordinance 8486, amending Chapter 16, Article 12, Section 16-1201, Access Management Requirements for West 6th Street.
