MV Transportation is willing to settle your claim in the amount of $33,700.00.

Enclosed please find a Release regarding the above-mentioned matter. After you have read the Release, please sign and forward the document to me. A check will be forwarded to you at the above address within fourteen (14) days of receipt of the original copy of the fully executed Release.

Checks are generated on a weekly basis. Releases received after the Monday cutoff will be paid the following week. We will accept a facsimile Release for check preparation, and mailing.

We, City of Lawrence, for ourselves, our heirs, executors, administrators, successors and assigns in consideration of THIRTY-THREE THOUSAND SEVEN HUNDRED DOLLARS AND 00/100 ($33,700.00), do hereby remise, release and forever discharge Fred White, MV Transportation, Inc., ACE American Insurance Company, its officers and agents, their representatives, employees, successors and assigns from and against all claims, demands actions and causes of action for damages when-so-ever and howsoever arising out of those events which occurred on or about June 10, 2009 in or near Lawrence in the State of Kansas.

IT IS UNDERSTOOD AND AGREED that neither this Release nor any payment made pursuant hereto is to be taken as an admission of liability on the part of any person in whose favor this Release is given. Furthermore, MV will retain salvage as part of this settlement.

The undersigned further agrees to indemnify all of the persons, entities, firms and corporations released hereby and to save them free and harmless from any claims, demands, actions, and causes of actions, of any person whatsoever, and any cost, expense, attorney’s fee, or other liability arising out of or resulting from any violation or breach of this agreement and release on the part of the undersigned.
