RE:	Former Farmland Nitrogen Facility

Staff requests authorization to submit a confidential, revised offer to the FI Kansas Remediation Trust to acquire the Former Farmland Nitrogen Facility, a 467 acre tract of land located on K-10 Highway.  The revised offer will be contingent upon, among other provisions, City Commission approval of the terms and conditions of the offer.  The City Commission approval will require the item to be placed as a regular agenda item on a future City Commission agenda.  The terms and conditions of the offer will be disclosed and the public will have an opportunity to comment.  Thereafter, the Commission will vote on the matter.  

Action Requested: Authorize the City Manager and the City’s attorneys to submit a revised offer and appropriate related legal documents to purchase the Former Farmland Nitrogen Facility, if appropriate.
