RE:	Annexation Request by Nate Anthony for Property Located at 1764 E. 1300 Road.

On November 25, 2009, the City received a Request and a Petition and Consent for Annexation from Nate Anthony, owner of record of property located at 1764 E. 1300 Road.  The property adjoins the boundary of the City of Lawrence, Kansas.   Mr. Anthony purchased the property in November and because of a failed septic system the property needs to be connected to the City’s sewer system.  To be connected to the City’s sewer system the property must be annexed into the City.   Mr. Anthony is aware that he will have to pay the City’s system development charges in order to connect to the sewer system. 

The property is less than 10 acres and pursuant to Resolution 4742 the request for annexation is not required to be presented to the Planning Commission.   The property is connected to the City water system but pays the out-of-city rate.  Upon annexation, the property will pay the in-city water rate.   Because the property owner has consented to annexation and the property adjoins the City, the annexation does not require approval from the Board of County Commissioners of Douglas County, Kansas. 

Action Requested: Receive Mr. Anthony’s request for annexation and, if appropriate, pass on first reading Ordinance 8479, annexing the property located at 1764 E. 1300 into the City of Lawrence, Kansas.
