ITEM NO. 1           ELECTION OF A CHAIR AND VICE-CHAIR FOR 2009-2010

 

Conduct elections for a Chair and Vice-Chair to serve during the 2009-2010 term.

 

Lane said Blaufuss had been doing an excellent job as Chair the past year along with Lowe as Vice-Chair.

 

Motioned by Lane, seconded by Kimball, to re-elect Blaufuss as the Chair of Board of Zoning Appeals.                                   

Motion carried unanimously, 6-0

 

Motioned by Lane, seconded by Kimball, to re-elect Lowe as vice-chair of Board of Zoning Appeals.                            

Motion carried unanimously, 6-0

ITEM NO. 3               MINUTES

Motioned by Lane, seconded by von Tersch, to approve the September 3, 2009 Board of Zoning Appeals minutes.                                    

Motion carried, 5-0-1 Kimball abstained

 

 

ITEM NO. 4               1725 MISSISSIPPI STREET [DRG]

 

B-9-12-09: A request for a variance as provided in Section 20-­1309 of the Land Development Code in the Code of the City of Lawrence, Kansas, 2009 edition.  The request is to allow the drive and parking to exceed the 12 feet maximum width allowed in Section 20-908(b)(3) of the City Code for a property in the RS5 District.  The applicant is seeking approval of a 25’ wide driveway in a portion of the front building setback to allow for two parking spaces.  The driveway pavement will begin to widen out at a point approximately 9’ west of the front property line; then angle to the northwest until reaching its ultimate width of 25’.  The property is legally described as Lot 6, less the North 10’ thereof, and all of Lot 7, all in Block 8, University Place Addition in the City of Lawrence, Douglas County, Kansas.  The subject property is located at 1725 Mississippi Street.  Submitted by Mark J. and Christine R. Douglas, the property owners of record.

APPLICANT PRESENTATION

Mark Douglas stated he was looking for additional parking without having to move a lot of cars.  He said his home was between Kansas University and Lawrence High and the extra parking spot would be used occasionally.

BOARD DISCUSSION

von Tersch said the project seemed straight forward.

 

Lowe said the applicant’s request seemed to be an issue with the Development Code that the Board was seeing from time to time.  Had the City not rezoned the area to RS5 District in 2006 the applicant would not have needed this variance because it would have been allowed by Code when the previous RS-2 zoning converted to RS7 District.

 

 

ACTION TAKEN

Motioned by Lane, seconded by Kimball, to approve the variance request for 1725 Mississippi Street, based on the findings of fact in the staff report.

 

                             Motion carried unanimously, 6-0

 

ITEM NO. 5               3400 RIVERRIDGE ROAD [DRG]

 

WithdrawnB-9-13-09: A request for a variance as provided in Section 20-1309 of the Land Development Code of the City of Lawrence, Kansas, 2009 edition.  The request is for a variance to reduce the 30 feet rear yard building setback required in Section 20-601(a) of the City Code to a minimum of 7 feet.  The variance is needed for the applicant to be able to construct a 165 square feet master bath addition on the northwestern side of the residence.  The property is legally described as: Lot 4, Block 4, Final Plat of Westridge Heights Addition to the City of Lawrence.  The subject property is addressed as 3400 Riverview Road.  Submitted by James S. and Cynthia A. Ford, the property owners of record.

Motioned by Kimball, seconded by Carpenter to adjourn the Board of Zoning Appeals meeting.
