RE:

Hanscom-Tappan Addition, Tract D – Burroughs Creek Trail Linear Park

As you are aware, the Burroughs Creek Trail project is currently under construction.  Right-of-way and property acquisition is complete.  Near 15th Street and Haskell Avenue and adjacent to Parnell Park, the Hansom-Tappan Addition was platted in 2005.  The fifty feet of abandoned railroad right-of-way adjacent to the addition was platted as Tract D of Block Two (Hanscom-Tappan Plat).  The eastern twenty-five feet of this tract was platted as a utility easement and the western twenty-five feet as a pedestrian and drainage easement.  The fee simple title to the tract still belongs to the developers of the project.  Parnell Investors, LLC would like to donate to the City of Lawrence, the remaining property interests of this tract.  It will become part of the Burroughs Creek Trail Linear Park.  The City has acquired fee simple interests in the abandoned railroad right-of-way throughout most of the trail alignment and this acquisition will extend that control of the right-of-way adjacent to the Hanscom-Tappan Addition (Right-of-Way Acquisition Map).  City legal staff can prepare the appropriate title work for acceptance of this donation.

Action Requested:

Authorize acceptance of a donation of Tract D, Block Two, Hanscom-Tappan Addition for the Burroughs Creek Trail Linear Park from Parnell Investors, LLC.
