RESOLUTION NO. 6863

A RESOLUTION FIXING A TIME AND PLACE FOR A HEARING PURSUANT TO THE PROVISIONS OF K.S.A. 12-1750, ET SEQ. AND CHAPTER 5, ARTICLE 11 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2009 EDITION AND AMENDMENTS THERETO, WHEREAS PERSONS HAVING AN INTEREST IN A STRUCTURE LOCATED AT LOUISIANA STREET LOT 230 IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS, COMMONLY KNOWN AS 1232 LOUISIANA STREET MAY APPEAR AND SHOW CAUSE WHY SUCH STRUCTURE SHOULD NOT BE CONDEMNED AND ORDERED REPAIRED OR DEMOLISHED.

WHEREAS, The Enforcing Officer has, in accordance with the provisions of K.S.A. 12-1750 et seq., and Chapter 5, Article 11 of the Code of the City of Lawrence, Kansas, 2009 Edition and amendments thereto, filed with the governing body of the City a statement in writing that the structure located on the following described premises in the City of Lawrence, Douglas County, Kansas, to-wit:

LOUISIANA STREET LT 230, commonly known as 1232 Louisiana Street

is unsafe or dangerous; and

            WHEREAS, the provisions of said statutes require that, upon the filing of such a statement with the Governing Body of the City, said Governing Body shall fix a time and place at which the owner, his agent, any lien holders of record and any occupant of such structure may appear and show cause why such structure should not be condemned and ordered repaired or demolished; and

            WHEREAS, proceeding under such statutes may ultimately result in accomplishment of repair or demolition by the City of Lawrence, Kansas, the owner’s loss of all rights in the salvage to the extent of the costs of such repair or demolition, and an assessment against the real property for said costs in excess of the value of the salvage.

            NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

That pursuant to the provisions of K.S.A. 12-1750 et seq., a hearing will be held in the City Commission Room, first floor, 6 E. 6^th Street, Lawrence, Kansas, on October 20, 2009 at 6:35pm, or as soon thereafter as the matter may be heard at which time and place the owner, the owner’s agent, any lien holders of record and any occupant of the structure located on the following premises in the City of Lawrence, Douglas County, Kansas, to-wit:

LOUISIANA STREET LT 230, commonly known as 1232 Louisiana Street

may appear and show cause why such structure should not be condemned and ordered repaired or demolished.

The City Clerk is hereby authorized to provide for publication, once each week for two consecutive weeks on the same day of each week, in the official newspaper of the City, the Resolution setting the hearing date and time.

ADOPTED by the Governing Body of the City of Lawrence, Kansas, this 1st day of September 2009.
