ORDINANCE NO. 8436

AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 1 OF THE CODE OF THE CITY OF LAWRENCE, KANSAS, 2009 EDITION, PERTAINING TO ALCOHOLIC LIQUOR.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:

Section 1.         Chapter 4, Article 1, Section 4-117 of the Code of the City of Lawrence, Kansas, 2009 Edition and amendments thereto, is hereby amended to read as follows:

4-117    RETAIL LIQUOR ESTABLISHMENTS: HOURS OF SALE.

(A)        The sale at retail liquor establishments of alcoholic liquor on Sundays shall only occur between the hours of 12:00 p.m. and 8:00 p.m.

(B)        The sale of at retail of alcoholic liquor shall not occur on Easter, Thanksgiving and Christmas.

(C)        On all other days except Sunday, the sale at retail liquor establishments of alcoholic liquor shall only occur between the hours of 9:00 a.m. and 11:00 p.m.

(D)        The sale at retail of alcoholic liquor at a farmers’ market pursuant to the authority of a valid Farmers’ Market Sales Permit issued by the State of Kansas may occur only during the hours specified by that permit unless otherwise authorized by Kansas law.

Section 2.         Severability. If any section, clause, sentence or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance. 

Section 3.         This ordinance shall take effect and be in force effective upon its passage and publication once in the official city paper as provided by law.
