On August 4, 2009, the City Commission held a public hearing pursuant to Section 20-1306(l) of the Land Development Code to amend, suspend, or revoke special use permit (SUP-01-02-07) and to consider increasing the overnight participant occupancy at the Lawrence Community Shelter, 944 Kentucky Street.
The City Commission found that the Lawrence Community Shelter had violated a condition of SUP-01-02-07 by increasing the occupancy of the shelter above the current restriction of only allowing 31 overnight participants by sleeping 21 in the day room on the 10th Street side and 21 on the patio behind the building. The City Commission considered the report and recommendation of the City’s professional staff, the evidence and testimony provided at the hearing and the requirements of the Development Code and voted 3-2 to amend SUP-01-02-07 from the current 31 overnight participants to allow 57 overnight participants, including staff, and then beginning October 1, 2009 through April 1, 2010 to allow 82 overnight participants, including staff with all of the other conditions of SUP-01-02-07 remaining. The increase in occupancy was subject to the improvements in the structure meeting the City’s building and fire codes and receiving a certificate of occupancy.
Staff recommends the Commission adopt Ordinance 8449 amending SUP 01-02-07 to increase the overnight participant occupancy at the Lawrence Community Shelter, 944 Kentucky Street.
