RESOLUTION NO. 6855
A RESOLUTION OF THE CITY OF LAWRENCE, KANSAS, PROVIDING FOR IMPROVEMENTS TO THE WATERWORKS AND WASTEWATER TREATMENT FACILITIES IN THE CITY; AND PROVIDING FOR THE PAYMENT OF THE COSTS THEREOF.
WHEREAS, Charter Ordinance No. 27 of the City of Lawrence, Kansas (the “City”) authorizes the City to make certain public improvements, including the improvement, repair or extension of any waterworks or wastewater treatment facility, or other public utility facility, and for the purpose of rebuilding, adding to or extending to the same improvement from time to time, as the necessities of the City may require; and
WHEREAS, Charter Ordinance No. 27 further authorizes the City to borrow money and issue bonds for such improvements, provided that the total amount of bonds issued for such purposes shall not exceed an amount established annually by the City Commission; and
WHEREAS, the governing body of the City hereby finds and determines that it is necessary and advisable to improve the City’s waterworks and wastewater treatment facilities by installing a water line from North 7th Street to the Lawrence Municipal Airport, and installing either a sewer line along a similar route or an on-site sewer treatment facility at the Lawrence Municipal Airport (the “Project”), and to provide for the payment of the costs thereof by the issuance of general obligation bonds; and
NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS:
Section 1. Project Authorization. It is hereby authorized, ordered and directed that the Project shall be constructed as a part of the water and sewer system of the City as provided by Charter Ordinance No. 27.
Section 2. Project Financing. The estimated costs of the Project, including construction, engineering fees, acquisition of right-of-way and easements, contingencies and administrative expenses is $2,000,000.00. The costs of the Project and associated financing costs shall be payable from the proceeds of tax-exempt, taxable or tax credit general obligation bonds of the City issued under authority of Charter Ordinance No. 27 (the “Bonds”).
Section 3. Reimbursement. The Bonds may be issued to reimburse expenditures made on or after the date which is 60 days before the date of this Resolution, pursuant to Treasury Regulation §1.150-2.
Section 4. This Resolution shall take effect and be in full force from and after its adoption by the governing body of the City.
