RE:	The Sandbar 20 Year Birthday Celebration Request for Alcohol Possession in a Beer Garden Area on 8^th Street

As part of a Temporary use of Right of Way Application related to a 20 Year Birthday Celebration for the Sandbar, Peach Madl, on behalf of Ricky Deans Inc., is requesting approval for age appropriate birthday celebrants to possess and consume alcoholic beverages in a controlled, fenced 10 X 22 foot area on 8^th Street in front of the Sandbar establishment from August 1 at 5:00 p.m. to August 2^nd at 1:00 am.  Sandbar staff is working with Alcohol Beverage Control to obtain approval to temporarily extend the existing licensed premises to cover this area for this event.  City Code section 4-105(E) allows the City to exempt, by ordinance, specified City property from the prohibition of alcoholic beverages on public property.  Therefore, an ordinance allowing the possession and consumption would be required.  Ordinance No. 8422 is attached for the Commission’s consideration.  Section 1 of Ordinance No. 8422 authorizes the possession and consumption of alcoholic beverages in a 10x22 foot area on 8^th Street immediately in front of the Sandbar area from August 1, 2009 at 5:00 p.m. until August 2^nd at 1:00 am provided such possession and consumption is otherwise pursuant to the Code of the City of Lawrence, Kansas and the laws of the State of Kansas.
