BEFORE THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS IN THE MATTER OF THE VACATION OF A UTILITY EASEMENT LOCATED IN LOTS 1 AND 8, LAWRENCE INDUSTRIAL PARK, IN THE CITY OF LAWRENCE, DOUGLAS COUNTY, KANSAS                                                                                        

 

ORDER OF VACATION

 

NOW on this 21st  day of April, 2009, the above entitled matter comes for hearing before the Governing Body of the City of Lawrence, Kansas.

 

THEREUPON, the Governing Body examines the matter, hears comments on the petition and being duly advised in the premises finds as follows, to-wit:

 

1.  The Governing Body has jurisdiction on the subject matter pursuant to K.S.A. 12-504 et seq. as amended.

 

2.  That notice of hearing of said petition and the affidavit of publication thereof are examined and found to have been duly made in strict conformity with the laws of the State of Kansas.

 

3.  That no private rights will be injured or endangered by such vacation.

 

4.  That no objection to said petition has been filed with the City Clerk at the time of or prior to the hearing.

 

5.  That the City Clerk shall certify a copy of this Order to the Register of Deeds of Douglas County, Kansas, for recording as provided by K.S.A. 12-505, as amended.

 

IT IS THEREFORE, BY THE GOVERNING BODY OF THE CITY OF LAWRENCE, KANSAS, CONSIDERED AND ORDERED that the following described right-of-way

 

A permanent utility easement recorded in Book 692 at Page 799, in the Office of the Douglas County Register of Deeds, lying in Lots 1 and 8, Lawrence Industrial Park, in the City of Lawrence, Douglas County, Kansas described as follows:

 

Commencing at the Northeast Corner of said Lot 8 “Lawrence Industrial Park” in the City of Lawrence, Douglas County, Kansas; thence South 01°28’14” East along the East line of said Lot 8 a distance of 26.92 feet for a Point of Beginning; thence continuing South 01°28’14” East along the East line of said Lot 8 a distance of 20.00 feet; thence South 88°58’57” West a distance of 149.89 feet; thence South 85°24’41” West a distance of 29.38 feet; thence South 81°53’46” West a distance of 31.68 feet; thence North 75°36’25” West a distance of 72.09 feet; thence North 53°06’23” West a distance of 54.33 feet to the South line of Lot 1 “Lawrence Industrial Park” in the City of Lawrence, Douglas County, Kansas; thence continuing North 53°06’23” West a distance of 86.80 feet; thence South 81°53’12” West a distance of 34.10 feet to the East Right-of-Way line of the abandoned A.T.S.F. Railroad; thence North 09°25’27” West along the East Right-of-Way line of the abandoned A.T.S.F. Railroad a distance of 20.01 feet; thence North 81°53’12” East a distance of 42.84 feet; thence South 53°06’23” East a distance of 120.75 feet to the North line of said Lot 8; thence continuing South 53°06’23” East a distance of 24.69 feet; thence South 75°36’25”  East a distance of 64.13 feet; thence North 81°53’46” East a distance of 28.32 feet; thence North 85°24’41” East a distance of 30.62 feet; thence North 88°58’57” East a distance of 150.36 feet to the Point of Beginning, containing 9198.4 Square Feet more or less, all in the City of Lawrence, Douglas County, Kansas.
