RE:	Charter Ordinance No. 38 Repealing Charter Ordinance No. 25 Relating to the Quorum of the City Commission

On March 10, 2009, the City Commission passed on first reading Ordinance No. 8379 establishing the quorum of the governing body at four members.  Ordinance No. 8379 passed on second reading on March 24, 2009. 

As explained in the attached staff memorandum, changes in state law make Charter Ordinance No. 25 unnecessary.  (Charter Ordinance No. 25 exempted the City from a state law that established the quorum of certain first class cities at three.) Since changes in state law make Charter Ordinance 25 unnecessary, the City Commission directed staff on March 10, 2009, to prepare a charter ordinance repealing Charter Ordinance No. 25.  Charter Ordinance No. 38, repealing Charter Ordinance No. 25, is attached.

Passage of Charter Ordinance No. 38 will require four members of the City Commission to vote in favor of it.

Action Requested:    Adopt Charter Ordinance No. 38, as appropriate.
