RE:                   Eighth Street Taproom Sidewalk Hospitality License

On March 10^th, 2009 the City Commission conditionally approved site plan SP-02-10-08 and the related Sidewalk Dining and Hospitality License for Louise’s Inc., doing business as 8^th Street Taproom.  The site plan and license approvals were both conditioned on the completion of a Use of Right of Way Agreement and an approved ordinance authorizing alcoholic beverages in sidewalk hospitality area.  Staff has recently received an executed Use of Right of Way Agreement and the necessary legal description of the sidewalk area to complete the ordinance allowing alcoholic beverages in the right of way.  A copy of Ordinance 8383 is attached, which after its effective date, would allow possession and consumption of alcoholic beverages in the 8^th Street Tap Room sidewalk hospitality area, provided the sale, possession, and consumption is consistent with all state and locals laws. 

City Clerk’s Office staff recommends approval Ordinance 8383.
