RE:

1207 E. 13th Street, unsafe structure

 

 

The referenced property has been inspected and found to be in violation of City Code, specifically the 2007 International Property Maintenance Code. The structure (house) was damaged by a fire on 1/27/08. The current condition of the structure is unsafe and posing a nuisance and unsafe condition for adjacent properties and residents.

The property owner secured a demolition permit on 7/31/08 and has been dismantling the structure since that date. The property owner has indicated he would have the structure removed; however it is staff’s opinion that to ensure the public’s safety, it must be removed in a more expedient manner.

 

Several previous hearings had been scheduled, however due to scheduling issues and a desire to review procedures, those hearings had been cancelled by staff.

 

At this time staff is requesting that a new public hearing date be set for 4/28/09. The purpose of the hearing will be to discuss the status of the property and structure and to consider adopting an order to remove or repair the structure within a specified time.  Failure of the owner to comply would result in the City taking action to remove the unsafe structure.
