The following is additional information addressing a question the Vice Mayor asked during the agenda review meeting on March 2 on whether the proposed use for gymnastics was an allowed use under the former zoning classification.

 

The subject property was zoned M-3 prior to its conversion to IG.  Under the 1966 code, the proposed use would have been permitted subject to site plan approval.

 

Original Zoning: M-3 Intensive Industrial District

 

Purpose. This district is designed to accommodate the manufacturing and industrial activities which involve more objectionable influences and hazards. The M-3 District regulations are designed to encourage the uses of this district by such industries, subject to the minimum regulations necessary for the mutual protection of the permitted uses

 

The G-force Athletics would have been classified in the 1966 code as a “Studio for Professional Work, for teaching of any form of fine arts, e.g. photography, music, dancing, drama, etc. or similar uses”

 

This use is included in Use Group 7: Community Facilities allowed in most zoning districts and the entire industrial zoning district subject to the approval of a Use Permitted upon Review (equivalent to a special use permit). The use is also found in Use Group 13. Automotive Sales; Retails Sales; Other allowed in the more intensive commercial districts and the M2 and M3 zoning district of the 1966 code subject to site plan approval only.

 

If the rezoning is approved, the use would be subject to site plan approval under the 2006 Development Code.
