Baggett, et al. v. Board of County Commissioners,

Case No. 08 CV 371, Division 1

 

 

 

The City is currently involved in two separate actions pending in Douglas County District Court related to the City’s annexation of approximately 155 acres of land located near K-10 Highway and Farmer’s Turnpike.  The Board of Douglas County Commissioners is a defendant in another action pending in district court related to the annexation of the 155 acres.  The case against the County is Baggett, et al. v. Board of County Commissioners (BOCC), Case No. 08 CV 371.  The City is not currently a party to this action, however, the City may petition the Court to intervene in the action.  If the petition is granted, the City will be a party to the lawsuit and its attorneys will represent the City’s interests in the action.    

 

Legal staff recommends the City intervene in the case, Baggett v. BOCC.

 

Action requested.  Authorize the City legal staff to file the appropriate documents with the Douglas County District Court to intervene in the case, Baggett v. BOCC, Case No. 08 CV 371.
