Use of Right-of-Way Adjacent to 642 and 824 Louisiana

The City Clerk’s office has received requests for temporary use of right-of-way permits for use of the sidewalk and street immediately adjacent to the properties at 642 and 824 Louisiana for the period of 12/10/08 through 1/10/09. Nineteenth Century Restorations is performing renovations at both properties and is using the right-of-way to store construction materials (see attached photos). Work on these properties has been underway since at least May 2008 and temporary use of right-of-way permits were applied for in May but never approved. Expected completion dates for the projects are mid-February for 824 Louisiana and mid-April for 642 Louisiana.

 

The City has received a complaint from a neighbor of 824 Louisiana objecting to the granting of a use of right-of-way permit at that location. The neighbor has expressed appreciation for the work being done, but objects to the extended time frame of the project, and the storage unit on the street which blocks the view of traffic and construction traffic at times driving over his curb and property.  The neighbor objecting to this request has been notified that this item is on the December 16 City Commission agenda for consideration.

 

ACTION:       Staff recommends approval of the use of right-of-way adjacent to 642 and 824 Louisiana for one month, 12/10/08 through 1/10/09, with additional one month extensions to be considered as needed, provided that any future extension requests must be applied for prior to the expiration of the then current temporary use of right-of-way permit, for the storage of construction materials.
