RE:	Agreement For Sale of Excess City Property

Please include the attached revised Agreement for Purchase and Sale of Real Estate between the City of Lawrence and the North Mass Redevelopment Group, L.L.C. on the City Commission’s agenda for action.  The City Commission received a Staff Report and a Proposed Purchase Agreement at its October 7, 2008 regular meeting.     

Revised Purchase Agreement

The Agreement for Purchase and Sale of Real Estate between the City of Lawrence and the North Mass Redevelopment Group, L.L.C. has been revised to include the sale of the levee right of way, unless the City determines, in consultation with the U.S. Army Corps of Engineers, that a portion of the land should be retained by the City.  See Section 2.  The Agreement has also been revised to clarify that either the City or the Corps will determine whether a setback is necessary as part of the plan approval process.  See Section 5.6.

Recommended Action

Staff recommends the City Commission authorize the City Manager to execute the Purchase Agreement, if appropriate.
