Vacation of Unused Utility Easement October 21, 2008 Regular Agenda Item |
Please include the following item on the City Commission regular agenda for consideration at the October 21, 2008 meeting:
On October 21, 2008 the City Commission will hold a public hearing to consider a request by owner Jack Biegler, Ellison KU, LTD, 70 N.E. Loop 410, Suite 545, San Antonio, Texas 78216 for the vacation of an unused utility easement located in Lot 1, Block 1, Legends Addition No. 1. An access easement follows the same alignment as the utility easement. The applicant is only requesting the vacation of the utility easement; the access easement will remain. Lot 1 has been revised and this utility easement will not properly service the lot. The Revised Final Development Plan meets the previous Final Development Plan density.
All utilities, as well as property owners within 200 feet, were notified. No objections have been received.
Action Requested: Hold public hearing and, pending discussion, approve order of vacation retaining the access easement.
