RE:	Ordinance 8326

Attached for City Commission consideration is Ordinance 8326.  The ordinance enacts Chapter 5, Article 21 – Excavations and Structures in Utility Easements.  These code provisions were previously part of Chapter 5, Article 2 of the Code of the City of Lawrence.

Chapter 5 – “Building and Construction” was amended in September 2007 in Ordinance 8180 to incorporate the International family of codes, with amendments.  Ordinance 8180 became effective January 1, 2008.  The code provisions in the above article were inadvertently omitted from Ordinance 8180.  Ordinance 8326 returns the regulations to Chapter 5.  There are no substantive changes to this article from the previous presence in the code.

Staff recommends adopting Ordinance 8326.
