Bauer Farm Maintenance Agreement

Please include the following item on the City Commission regular agenda for consideration at the August 5, 2008 meeting:

 

On March 4, 2008 the City Commission approved the Preliminary Development Plan for Bauer Farm with the condition that an agreement be approved/executed between the City and Bauer Farm owners to specifically identify the extent of public/private areas and maintenance responsibilities within the development. Attached for the Commission’s approval is that maintenance agreement. 

 

The agreement includes:

*        Identify an owners’ association to maintain common areas.  If an owners’ association is not formed the responsibilities of the owners’ association will be imposed upon the owners of the properties.

*        Clarification by definition of alleyways, amenity areas, and angled parking. 

*        Utilities located within the right-of-way will be approved by Public Works and installed prior to streets and sidewalks.

*        Clarification of snow removal practices.

*        Street lighting – the owners desire an ornamental pole and light fixture and will pay for the initial installation. The city shall pay for electricity and ongoing maintenance, including replacement of light bulbs.

*        Street/alley maintenance, parallel/angled parking and snow removal will be maintained in accordance with current city policies and practices. 

*        Exhibit B identifies public and private streets, alleyways, angled and parallel parking, and landscaped, amenity, detention, and sign easement areas.

While some of these issues may seem obvious, as individual ownership or properties change over time, expectations of maintenance responsibilities are sometimes misunderstood by new owners.  This agreement memorializes the owners’ responsibilities and clearly identifies city maintenance activities.

 

Action Requested

Approve Maintenance Agreement between City of Lawrence and Owners of Bauer Farm. Authorize Mayor to sign agreement.
