RE:	July 15, 2008 Consent Agenda Item Indiana Street Vacation – Oread Inn Applicant Withdraws Vacation Request

Please include the following item on the City Commission agenda for consideration at the July 15, 2008 meeting:

On May 20, 2008 the City Commission received a request from Oread Inn, L.C. to vacate the right-of-way 3’ east of Indiana Street between 11^th and 12^th Street adjacent to Lot 1 of the Triple T Addition.  The need for this vacation arose from potential construction issues of the below ground parking structure.  On June 17, 2008 the City Commission opened the public hearing and, at the applicant’s request, deferred the hearing.  

The development has made progress on the excavation since the request and the vacation application has been withdrawn.

Action Requested:  Withdraw application for the vacation of the east 3’ of Indiana Street between 11^th and 12 Street adjacent to Lot 1 of the Triple T Addition.
